PROJECT DESCRIPTION: The site is located at 1036 Water View Court, located within The Cove subdivision adjacent to the Carolina Beach Yacht Basin/ Myrtle Grove Sound and the Atlantic Intracoastal Waterway (AIWW) in Carolina Beach, New Hanover County. To locate the project site from South College Road (NC Highway 132) and Carolina Beach Road (NC Highway 421), travel south on Carolina Beach Road to the Carolina Beach high rise bridge. Cross the Snows Cut/AIWW to the Town of Carolina Beach, at the first stop light turn left on Access Road. Turn right onto Lewis Drive and travel approximately 0.35 miles until you reach St. Joseph Street. Turn right on St. Joseph Street and travel approximately 0.5 miles south until you reach the entrance to the Cove subdivision on the left. The property of interest is located at the end of the cul-de-sac. The property site is approximately 0.25 acre total with approximately 81.9 feet of shoreline frontage that is stabilized with wooden bulkhead. The applicant maintains a two-story single family residence. The high ground elevation is approximately 7 feet above mean sea level with highground vegetation consisting of maintained ornamental landscaping and lawn grass. Waterward of the bulkhead is an area of common reed (Phragmites australis) approximately 25 feet in width, which transitions in an area of highmarsh consisting of black needlerush (Juncus roemerianus). The high marsh transitions to an area of low marsh consisting primarily of smooth cordgrass (Spartina alterniflora). The applicant maintains an existing private docking facility within Myrtle Grove Sound. The access pierto the docking facility measures 6 feet wide by approximately 130 feet long, which terminates at a 16 feet wide by 16 feet long covered gazebo. The pier continues through the gazebo an additional 4 feet and terminates onto an access ramp to a floating dock, measuring 8 feet wide by 16 feet long. A boatlift, measuring approximately 13 feet wide by 13 feet long is located on the southern side of the floating dock. There are two "jet-ski" type of floating platforms currently located on the northern side of the floating dock. The existing docking facility currently provides permanent dockage for three (3) vessels. Based on the riparian survey provided by the applicant dated September 13, 2010, the existing docking facility extends on the landward end of the Town of Carolina Beach Pierhead Line 42.67 feet, which this line is landward of the western edge of the AIWW Channel Setback Line 86.57 feet. The survey also depicts that the existing docking facility encroaches into the adjacent riparian property owners' 15 foot setback requirement (See attached survey). The Town of Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Transitional. The waters of the Carolina Beach Yacht Basin/ Myrtle Grove Sound are classified SB by the Division of Water Quality. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. The open water of the CBYB and Myrtle Grove Sound is approximately 450 feet wide at this location. 10. PROPOSED PROJECT: The applicant proposes to reconfigure an existing private docking facility with a new fixed platform, floating dock, boatlifts and "jet-ski" type floating platforms to accommodate four vessels. The applicant proposes to construct a new platform, measuring 5 feet wide by 8 feet long on the southern side of the existing access pier, which would run parallel to the shoreline. An access ramp would extend from this platform onto a new floating dock, measuring 6 feet wide by 56 feet long. The floating dock would extend to the landward side of the Town of Carolina Beach Pierhead Line. The existing boatlift would be relocated to the most landward end of the southern side of the proposed floating dock and the existing "jet-ski" type of floating platforms would be relocated on the most waterward end of the northern side of the floating dock. A new two pole mounted boatlift, measuring 6 feet wide by 13 feet long would be located on the most landward end of the northern side of the floating dock. The application states that the water depth for the proposed structures would be located within approximately -6.0 feet to -10.0 feet at normal low water (See Sheets 1 of 6 through 5 of 6). ANTICIPATED IMPACTS: The proposed structures would incorporate 737 sq. ft. of Estuarine Waters and Pubic Trust Area, which would essentially usurp an area currently occupied by existing structures. Minor increases in turbidity should be expected during construction. The proposed structures would extend approximately 100 feet into a waterbody, which measures approximately 450 feet across. This distance would conform with both the 1 /4 rule and the established Town of Carolina Beach Pierhead Line. Based on the application, the proposed structures appear to be removed from the current encroachment into the northern adjacent riparian property owner 15 foot setback requirement; however, the proposed structure would encroach into the southern adjacent riparian property owner 15 foot setback requirement. The applicant has received a signed waiver from the adjacent property owner to the south to allow for the encroachment.
