Based on the response, the provided downstream flow data, the circumstances surrounding the cause of the non-compliance and the Town’s current actions to enter into an SOC with the Division, we will take no further action with regards to this notice at this time. We encourage the Town to continue to maintain open communication regarding any non-compliant events and/or upsets at the facility. I hope that our honest response to lack of flow data in the report (leaving the flow sections blank) and our reporting the flows from our second flow meter will help mitigate any fines that this type of violation incurs.
