Dear Mr. Hites,
The Asheville Regional Office has reviewed the Town of Waynesville’s response to the Notice of
Violation-Notice of Intent to Assess (NOV-2020-MV-0152). Based on the response, the provided
downstream flow data, the circumstances surrounding the cause of the non-compliance and the
Town’s current actions to enter into an SOC with the Division, we will take no further action with
regards to this notice at this time. We encourage the Town to continue to maintain open
communication regarding any non-compliant events and/or upsets at the facility.

Mikal: Thank you for speaking with me regarding our monitoring failure in September. I am attaching
our formal response to the violation along with the flow information I sent you earlier in the day. I
hope that our honest response to lack of flow data in the report (leaving the flow sections blank) and
our reporting the flows from our second flow meter will help mitigate any fines that this type of
violation incurs.
