Dear Mr. Chapin and Mr. McMillan:
S&ME, Inc. (S&ME), working with Woolpert, Inc. (Woolpert) on behalf of the applicant
Charlotte Mecklenburg Utilities (CMU), hereby submits a request for extensions of
project authorizations under Nationwide Permit (NWP) No. 12 and the corresponding
Water Quality Certification (WQC) 3699. These authorizations, issued in May 2009,
were for approximately 20 linear feet (If) of permanent stream impacts and 0.05 acre of
wetland impacts. The authorizations are set to expire in May 2011. The reason for the
need for extension of authorization is that there have been some construction delays
associated with the project.
The McKee Creek Interceptor begins near the Mecklenburg County/Cabarrus County line
(35.25798°N, 80.64664°W) and extends northeast (paralleling McKee Creek) to its tie
into the Reedy Creek Interceptor (35.28776°N, 80. 62907°W). The McKee Creek
Interceptor project involves installation of approximately 12,8001f of gravity sewer in
Cabarrus County, North Carolina. The proposed pipe size is 24 inches in diameter.
Permanent utility easements will be 60 feet, of which 10 feet will be maintained. The
project will provide new sanitary sewer service in the McKee Creek Basin and is
designed to accommodate predicted flows through the 2050 design year in Cabarrus
County. The proposed project will convey wastewater to the Reedy Creek Interceptor
(USACE Action ID No. SAW-2008-01353-360), from which it will travel through the
Lower Rocky River Influent Pump Station and ultimately be conveyed to and treated at
the Rocky River Regional Wastewater Treatment Plant located in Cabarrus County.

Since the issuance of the original authorizations in May 2009, minor design changes have
occurred. Design changes increased the total linear t®otage of the sewer line from 121800
linear feet (if) to 13,010 if The additional 210 if of sewer line is the result of the
relocation of a flow meter station from Cabarrus County to Mecklenburg County. The
relocation of the flow meter station does not result in additional impacts different frorn
the original permitted impacts.
Construction delays have been due to a combination of factors, including the current
economic conditions, delayed funding acquisition, the minor design changes, and the
discovery of an Ecosystem Enhancement Program (EEP) easement, obtained by a
landowner during easement acquisition by WSACC. As a result of delayed funding and
negotiations with EEP to resolve the easement encroachment and anticipated design
changes, construction of the proposed project is not anticipated to commence until after
January 2011. Though minor design changes will be implemented to accommodate
requests from EEP, no additional impacts will be incurred. Construction duration for the
approximately 13,010 if gravity sewer is estimated to be one year, well beyond the May
2011 permit expiration. Therefore, on behalf of Woolpert and CMU, we are requesting
an extension of the current NWP and WQC authorizations to accommodate construction
scheduling.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject the
permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of
the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (ie., are
under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the
activity is completed within twelve months of the date of the. nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to
modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You

A: INITIAL PROFFERED PERMIT: You may accept or object to the permit.
ACCEPT: If you received a Standard Permit, you may sign the permit document and return it to the district engineer for final
authorization. If you received a Letter of Permission (LOP), you may accept the LOP and your work is authorized. Your signature

provide new information.

You have our approval, in accordance with the general certification and those conditions listed below,
to impact 2.96 acre of wetland (0.05 ac., permanent) and 270 linear feet (10 ( 20 If permanent, McKee Creek) of
stream in order to construct the project in Cabarrus County, as described in your application received by the
Division of Water Quality (DWQ) on April 23, 2069. Aftef reviewing your application, we have determined that
this project is covered by Water Quality General Certification Number 3699, which can be viewed on our web
site at http://l12o.enr.state.nc.us/ncwetlands. The General Certification allows you to use Nationwide Permit
Number 12 once it is issued to you by the U.S. Army Corps of Engineers. Please note that you should get any
other federal, state or local permits before proceeding with your project, including those required by (but not
limited to) Sediment and Erosion Control, Non-Discharge, and Water Supply Watershed regulations.
The above noted Certification will expire when the associated 404 permit expires unless otherwise
specified in the General Certification. This approval is only valid for the purpose and design that you described
in your application. If you change your project, you must notify us in writing, and you may be required to send
us a new application for a new certification. If the property is sold, the new owner must be given a copy of the
Certification and approval letter, and is thereby responsible for complying with all conditions.
In addition to the requirements of the certification, you must also comply with the following conditions:
The Mooresville Regional Office shall be notified in writing once construction at the approved impact areas
has commenced.
2. Existing stream dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be
maintained.
3. The forested wetland areas outside of the permanent maintained easement shall be planted with woody
vegetation (native specie trees). All wetlands, streams, surface waters, and riparian buffers located on the
project site where impacts are not allowed shall be clearly marked (example- orange fabric fencing) prior to
any land disturbing activities.

4. Use of native vegetation and other soft stream bank stabilization techniques must be used where practicable
instead of riprap or other bank hardening methods. If riprap is necessary, it shall not be placed it the
streambed, unless approved by the DWQ.
5. Sediment and erosion control measures shall not be planed in wetlands or waters without prior approval from
DWQ. If approved, they shall be removed and the natural grade restored within two months of the date of
the close o1-.it/stabilization of the given drainage area.
6. Upon completion of the project, the applicant shall complete and return the enclosed "Certificate of
Cornpletion" form to the 401/Wetlands Unit of the NC Division of Water Quality.
7. Continuing Compliance. The applicant (Charlotte-Mecklenburg Utilities) shall conduct all activities in a
manner so as not to contravene any state water quality standard (including any requirements for compliance
with section 303(d) of the Clean Water Act) and any other appropriate requirements of state and federal law.
If DWQ determines that such standards or laws are not being met (including the failure to sustain a
designated or achieved use) or that state or federal law is being violated, or that further conditions are
necessary to assure compliance, DWQ may reevaluate and modify this certification to include conditions
appropriate to assure compliance with such standards and requirements in accordance with 15 A NCAC
21-1.0507(d). Before codifying the certification, DWQ shall notify the applicant and the US Army Corps of
Engineers, provide public notice in accordance with 15A NCAC 2H.0503, and provide opportunity for public
hearing in accordance with 15A NCAC 21-1.0504. Any new or revised conditions shall be provided to the
applicant in writing, shall be provided to the United States Army Corps of Engineers for reference in any
permit issued pursuant to Section 404 of the Clean Water Act, and shall also become conditions of the 404
Permit for the project.
If you do riot accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition that conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative
Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final
and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
