This inspection was conducted to verify that the facility is operating in compliance with the conditions and limitations specified in NPDES WW Permit No. NC0079481. A summary of the findings and comments noted during the inspection are provided in the enclosed copy of the inspection report. The Compliance Evaluation inspection was conducted by Division of Water Resources staff from the Asheville Regional Office. The plant was sampled for BOD, TSS and fecal coliform. The results were as follows: BOD 21 mg/l TSS 25 mg/l Fecal Coliform 120 cfu/100ml A new bar screen has been put in place in the EQ basin however, the spacing of the bars is not adequate to prevent large debris from getting into EQ basin. More bars need to be welded on the screen to retain larger debris, which will prevent it from entering plant. Due to recent violations for TSS and fecal coliform, the plant should be pumped more frequently, to assist in keeping the solids load in compliance. There are no adequate safeguards at the facility should a power outage occur. Refer to Section C #7 of the permit for requirements. A tag along portable generator of sufficient size should be available for this facility. This assessment is based upon the following facts: a review has been conducted of the discharge monitoring report (DMR) submitted by Dennis J Whitson for the month of May 2014. This review has shown the subject facility to be in violation of the discharge limitations and/or monitoring requirements found in NPDES Permit No. NC0079481. The violations, which occurred in May 2014, are summarized in Attachment A to this letter. Based upon the above facts, I conclude as a matter of law that Dennis J Whitson violated the terms, conditions or requirements of NPDES Permit No. NC0079481 and G.S. 143-215.1(a)(6) in the manner and extent shown in Attachment A. In accordance with the maximums established by G .S. 143-215.6A(a)(2), a civil penalty may be assessed against any person who violates the terms, conditions or requirements of a permit required by G .S. 143-215.1(a). Based upon the above findings of fact and conclusions of law, and in accordance with authority provided by the Secretary of the Department of Environment and Natural Resources and the Director of the Division of Water Resources, I, G.
