Hodges Creek in order to construct a commercial car lot on the south side of NC Hwy 105, in Boone,
Watauga County, North Carolina.

YOUR APPLICATION/PRECONSTRUCTION NOTIFICATION IS INCOMPLETE AND CANNOT
BE EVALUATED UNTIL THE FOLLOWING INFORMATION IS RECEIVED (CHECK ALL THAT

Your application/pre-construction notification form has not been completed and/or signed. (see
remarks)
X Under the conditions of Nationwide Permit # 39 , you are required to submit an aquatic resource
mitigation plan. The required plan is either insufficient or has not been included with your
notification (see remarks).
X Your application/pre-construction notification did not include information describing measures you
have implemented to avoid and minimize losses of Waters of the United States.
X Your submitted project plans or maps were insufficient, too large, or not legible (see remarks)
Your application/pre-construction notification did not include a delineation of affected special
aquatic sites, including wetlands, vegetated shallows, and riffle and pool complexes as required.
You must submit a copy of your application to the NC Wildlife Resources Commission (WRC)
since your proposed work is in a designated trout water county (see remarks section below for the
address of your WRC representative)

REMARKS: Information should be submitted that documents avoidance and minimization on the project
site specifically the availability of parcels nearby that may also serve the project purpose. We are aware of
previously permitted and/or other parcels along the same commercial corridor that are available which
may be adequate sites for a commercial car lot. Plans should also be submitted that show the design for
the proposed lot in more detail versus just showing the footprint of the fill. Finally, a mitigation plan
should be submitted that adequately compensates for impacts to the wetlands on site provided you've
demonstrated practicable avoidance and minimization measures. The wetland area proposed for impact is
one of the few (if not last) remaining wetlands adjacent to Hodges Creek which supports wild brown trout.
The wetland provides valuable storm water treatment functions for Hodges Creek and downstream waters.
Any proposed plan should provide for mitigation at a 2:1 ratio. If the requested information is not
submitted to our office within 30 days from the date this letter is received, we will assume that you longer
wish to pursue this project and will withdraw your permit application.
