ECS Carolinas, LLP (ECS) is pleased to submit this report of the jurisdictional waters/wetland
determination for the site located on West Wendover Avenue in Greensboro, Guilford County,
North Carolina. This report summarizes our findings for the site.
Background
The site consists of a drainage swale that is located south of West Wendover Avenue in
Greensboro, Guilford County, North Carolina (Figure 1). The drainage swale contains grass-
covered areas with a narrow wooded buffer and undeveloped, wooded land. ECS was
contracted to delineate jurisdictional waters including ponds, streams and wetlands on the site.
Wetlands are defined by the U.S. Army Corps of Engineers and the United States
Environmental Protection Agency as "those areas that are inundated or saturated by surface or
groundwater at a frequency and duration sufficient to support, and under normal circumstances,
do support a prevalence of vegetation typically adapted for life in saturated soil conditions." In
order for an area to be classified as wetland, hydrophytic vegetation, hydric soils, and wetland
hydrology indicators must be present.
Literature Review
We have reviewed the USGS Topographic Map, the Soil Survey of Guilford County and the
Geologic Map of North Carolina to obtain information regarding the site.
• The USGS Topographic Map (Figure 1) shows an unnamed tributary to South Buffalo Creek
in the drainage swale that was evaluated as part of this study.
The USDA Soil Survey of Guilford County (Figure 2) shows soils in the vicinity of the
drainage swale are mapped as Enon fine sandy loam (EnD), Madison sandy loam (MaE)
and Wehadkee loam (WhA). The Enon series consists of well drained, slowly permeable
soils that occur on ridgetops and side slopes. The Madison series consists of well drained,
moderately permeable soils that occur on gently sloping to steep uplands. The Wehadkee

series consists of poorly drained and very poorly drained, moderately permeable soils that
occur on floodplains along streams. The Wehadkee series is identified on the Hydric Soils
List for Guilford County as being hydric or as having hydric soils as a major component. The
other soils on the site are not identified on the Hydric Soils List for Guilford County.
The Geologic Map of North Carolina indicates that the site is located in the Carolina Slate
Belt of the Piedmont Physiographic Province. The soils encountered in this area are the
residual product of in-place chemical weathering of rock presently underlying the site. In
general, shallow unconfined groundwater movement within the overlying soils is controlled
largely by topographic gradients. Recharge occurs primarily by infiltration along higher
elevations and typically discharges into streams or other surface water bodies. The
elevation of the shallow water table is transient and can vary greatly with seasonal
fluctuations in precipitation. Movement in this water table is generally from higher to lower
elevations. As such, shallow groundwater would be expected to flow beneath the site
toward the unnamed tributary to South Buffalo Creek.
Site Reconnaissance
The site consists of a drainage swale that is located south of West Wendover Avenue in
Greensboro, Guilford County, North Carolina. The drainage swale contains grass-covered
areas with a narrow wooded buffer and undeveloped, wooded land.
ECS performed a site reconnaissance on October 12, 2010. During our reconnaissance, we
observed the site for evidence of ponds, streams and wetlands. We did not observe ponds on
the site. A stream originates from a culvert beneath West Wendover Avenue and traverses
through the drainage swale. The stream has a defined bed and defined banks, substrate
sorting, iron-oxidizing bacteria and contained flowing water at the time of our site visit. Based
on our observations, the stream is perennial. The stream centerline was marked in the field with
blue and white striped surveyor tape.
Hydrophytic vegetation was observed in several areas adjacent to the stream. The stream on
the site is high banked. Wetland hydrology indicators and hydric soils were not observed
outside of the banks of the stream. An area near the southeastern boundary contained
hydrophytic vegetation and wetland hydrology indicators. However, hydric soil indicators were
weak. The area was not flagged as wetland. The U.S. Army Corps of Engineers may consider
this area to be a jurisdictional wetland. The soils are bright and appear well drained to depths of
at least twelve inches. Routine Wetland Determination Data Forms supporting our opinions are
included as attachments.
Figure 3 shows the approximate locations of the stream and data points. Figure 3 is based on
our field notes and should only be used for preliminary planning purposes. We recommend that
the delineation be verified by the U.S. Army Corps of Engineers and the North Carolina
Department of Environment and Natural Resources (NCDENR), Division of Water Quality. After
the site has been verified, a survey should be performed to determine the exact locations and
extent of the jurisdictional areas.

General Discussion
Section 404 of the clean Water Act regulates the discharge of dredge and fill materials into
waters of the United States (lakes, rivers, ponds, streams, etc.), including wetlands. Waters of
the United States include the territorial seas, navigable coastal and inland lakes, rivers and
streams, intermittent streams, and wetlands. Activities that could be regulated under Section
404 include the placement of fill for construction of roadways; residential, commercial or
industrial structures; and the construction of water retention ponds along tributaries. The EPA
and the U.S. Army Corps of Engineers jointly administer the Section 404 program. Section 401
of the Clean Water Act grants each state the authority to approve, condition, or deny any
Federal permits that could result in a discharge to State waters.
The stream located on the site is regulated by the U.S. Army Corps of Engineers and the North
Carolina Division of Water Quality. Permits will be required prior to impacting open waters,
including perennial or intermittent streams. Mitigation and stormwater management plans will
be a condition of any permits issued for the site. Buffers may be required adjacent to the
stream channels.
For impacts to more than 300 linear feet of stream channel, an individual permit (IP) may be
required. An IP requires a habitat analysis, alternative site analysis, project justification, plans
to avoid and minimize impacts, and a proposed mitigation plan. Depending on the habitat
analysis and the extent of impacts, and Environmental Impact Statement may be required by
the U.S. Army Corps of Engineers. An IP allows for a public comment period and may require 4
to 18 months to obtain depending on conditions arising during the U.S. Army Corps of
Engineers review and public comment period.
Watershed Classification
An unnamed tributary to South Buffalo Creek crosses the site. According to the North Carolina
Department of Environment and Natural Resources (NCDENR), Division of Water Quality, the
site is located in the Cape Fear River Basin in an area that has been classified as WS-V;
nutrient sensitive waters (HUC = 03030002).

Dear Mr. Nooe:
This letter is to inform you that a list of all federally-protected endangered and threatened species
with known occurrences in North Carolina is now available on the U.S. Fish and. Wildlife
Service's (Service) web page at http://www.fws.gov/raleigh. Therefore, if you have projects that
occur within the Raleigh Field Office's area of responsibility (see attached county list), you no
longer need to contact the Raleigh Field Office for a list of federally-protected species.
Our web page contains a complete and frequently updated list of all endangered and threatened
species protected by the provisions of the Endangered Species Act of 1973, as amended (16
U.S.C. 1531 et seq.)(Act), and a list of federal species of concern' that are known to occur in
each county in North Carolina.
Section 7 of the Act requires that all federal agencies (or their designated non-federal
representative), in consultation with the Service, insure that any action federally authorized,
funded, or carried out by such agencies is not likely to jeopardize the continued existence of any
federally-listed endangered or threatened species. A biological assessment or evaluation may be
prepared to fulfill that requirement and in determining whether additional consultation with the
Service is necessary. In addition to the federally-protected species list, information on the
species' life histories and habitats and information on completing a biological assessment or
evaluation and can be found on our web page at http://www.fws.gov/raleigh. Please check the
web site often for updated information or changes.
' The term "federal species of concern" refers to those species which the Service believes might be in need of
concentrated conservation actions. Federal species of concern receive no legal protection and their designation does
not necessarily imply that the species will eventually be proposed for listing as a federally endangered or threatened
species. However, we recommend that all practicable measures be taken to avoid or minimize adverse impacts to
federal species of concern.
If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you detennine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Enviromnental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
With regard to the above-referenced project, we offer the following remarks. Our comments are
submitted pursuant to, and in accordance with, provisions of the Endangered Species Act.
Based on the information provided and other information available, it appears that the proposed
action is not likely to adversely affect any federally-listed endangered or threatened species, their
formally designated critical habitat, or species currently proposed for listing under the Act at
these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for
your project. Please remember that obligations under section 7 consultation must be
reconsidered if. (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered; (2) this action is
subsequently modified in a mamier that was not considered in this review; or, (3) a new species
is listed or critical habitat determined that may be affected by the identified action.
However, the Service is concerned about the potential impacts the proposed action might have
on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we
recommend that all practicable measures be taken to avoid adverse impacts to aquatic species,
including implementing directional boring methods and stringent sediment and erosion control
measures. An erosion and sedimentation control plan should be submitted to and approved by
the North Carolina Division of Land Resources, Land Quality Section prior to construction.
Erosion and sedimentation controls should be installed and maintained between the construction
site and any nearby down-gradignt surface waters. In addition, we recommend maintaining
natural, vegetated buffers on all streams and creeks adjacent to the project site.
The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a
copy can be found on our website at (http://www.fws.gov/raleigh) to address and mitigate
secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality.
We recommend that you consider this document in the development of your projects and in
completing an initiation package for consultation (if necessary).
