Hi Amy,
Sorry it took so long to get back to you but I wanted to talk to the engineer to ask him what he would like as
an extension.
He has been working feverishly to get it done but when I said he could name a date, he asked for January 11.
2011.
If that is too much of an extension, he would take anything as late as possible in December.
The current deadline is November 22 which is Monday.

I have a question about one paragraph of the letter from NCDWQ.
Sorry about the quality but I cut and pasted this from a pdf of the letter from NCDWQ. According to the letter
I need to submit a stormwater management plan within 60 days of the letter as follows:
4. Written Stormwater Management Plan (Final Plan Needed)
,A final, written stormwater management plan shall be submitted to the 401 Oversight and
Express Permitting Unit (2321 Crabtree Blvd., Suite 250, Raleigh, NC, 27604) within 60
du.vs- ofthe issuance of the Miner Variancc. The stormwater management plans shall be
approved in \vriting by this Office before the impacts specified in this variance occur.
YOU have the option of using the Express Review Program for expedited approval ol.
these plans. l l'you propose to use the Express Review Program, remember to include the
appropriate fee with the plan. The stormwater management plan must include
construction plans, specifications, stormwater BMP worksheets, and supporting
calculations. The structural stormwater practices as approved by this Office as well as
drainage patterns must be maintained in perpetuity. No changes to the structural
stormwater practices shall be made without written authorization from the DWQ.

My quesfion is, if I need an additional week or 2 to submit the plans, elsewhere in the letter is says I need to
file a petition to contest any part of the letter within the same 60 days. Is it possible to get an extension
without going through that extra petition process?
Also I was wonder how long is the normal review process and how much does the Express Review Program
cost.

Hi Art.
For question #2: We need to see a shaded area for where the impact in the buffer will be. You can label that as "buffer
impact" or "Zone 2 impact".
For #1: We just need to see that your impact is in Zone 2 and not Zone 1. So if you have a scale on your plans, you can
just mark off the Zone 2 area with a line and label it as Zone 2.
If any of this is confusing, please let me know.

Hi Amy,
I just received the attached request for additional information from the NCDENR.
I believe I understand question 2...... even though from my survey showing the 50 foot buffer, I am only going
16 feet maximum into the buffer, they want me to show the 20 foot line between buffer 1 and buffer 2. 1 can
have the surveyor add that line if needed.
But I do not understand what is needed for question 1. 1 only have a single impact..... unless I don't
understand something. Am I supposed to just label it Impact 1? Is that the issue?
