Please find attached the As-Built/MYO Credit Release letter for the RES Yadkin 01 Umbrella Mitigation Bank:
Compass Point Mitigation Site (SAW-2017-01465). As requested, 15% credit is being released for satisfying the
second release requirements (completion of all initial physical and biological improvements) pursuant to the
Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the RES Yadkin 01 Umbrella Mitigation
Bank, signed by USACE on November 25, 2019, and the Compass Point Final Mitigation Plan, dated August
2019. In accordance with the plan as adjusted by the As -Built Baseline Report, 622.3 stream mitigation units
(SMU's) are now available for the Compass Point Mitigation Site. Feel free to contact me with any questions.

This correspondence is in reference to the As -Built Baseline Monitoring Report dated
August 2020, submitted in support of your request for the second credit release for the Compass
Point Mitigation Site. Also please reference the NC Interagency Review Team (NCIRT) virtual
As -Built site review held on October 8, 2020. The Compass point Mitigation Site is part of the
RES Yadkin 01 Umbrella Mitigation Bank, located west of Pulliam Road, approximately 4.5
miles northeast of Booneville, in Yadkin County, North Carolina. The purpose of this letter is to
confirm the second release of credits for this mitigation site.
The final mitigation plan approved December 4, 2019, included a 16.5-acre project with
stream restoration and enhancement generating 4,161 (not 4,130 as incorrectly noted in the initial
credit release) Cool Stream Mitigation Units (SMU) along three unnamed tributaries that drain
directly to the Yadkin River in the Upper Yadkin Watershed of the Upper Pee Dee River Basin
(03040101). The As -Built Report noted a decrease in the easement area of 0.04 acres at the top
of DWI -A not disclosed in the initial credit request. The easement was offset 30 feet from the
parcel line, however, during the original survey an incorrect parcel line was used. This error was
corrected in the recorded easement but was never updated in the design files. Therefore, the
length of DWI -A is now 15 linear feet (6 SMUs) shorter in As -Built than what was shown in the
Mitigation Plan, causing a reduction in total site credits from 4,161 SMUs to 4,155 SMUs.
Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish
the RES Yadkin 01 Umbrella Mitigation Bank, approved December 4, 2019; and the site -specific
Compass Point Final Mitigation Plan dated August 2019, fifteen percent (15%) of the mitigation
site's total restoration and enhancement credits shall be available for sale immediately upon
completion of all initial physical and biological improvements made pursuant to the Mitigation
Plan, dated August 2019 and approved December 4, 2019.
By copy of this correspondence, we confirm that you have satisfied the above
requirements for the second credit release for all parcels within the bank; and 622.3 SMU's
constituting 15% of the mitigation site's total restoration and enhancement credits are now
available for sale. This credit release has been adjusted due to the overall site reduction of 6
SMU's discussed above and subtracting the surplus 0.95 SMU issued during the initial credit
release. The site does not include any preservation credits. Including this credit release, 1,246.5
SMU's have now been released for the Compass Point Mitigation Site which totals, 30% of the
approved credit, as detailed in the approved final mitigation plan and As -Built Report.
During the NCIRT virtual site meeting of October 8, 2020, several comments were made
by agency representatives regarding concerns noted with the as -built conditions. These
comments were either noted in the October 16, 2020 meeting minutes, distributed by RES, via
email, or as additional comments/corrections to the minutes distributed. These include:
1. In order to address concerns regarding changes made to the planting plan (including
species planted), RES staff will begin removing all black walnut stems throughout the
site, including within vegetation plots.
2. After comments regarding the location of stream gauges being placed mid -way down
reaches (for example Reach DWI -A), RES will locate future gauges closer to the top of
reaches for future projects.
3. Concern was raised about the minimal amount of material covering the culverts at the
top of the site, as well as, the lack of material between the culverts increasing the
likelihood of the culverts being washed out or failing. Evaluate whether repairs are
needed to maintain long term stability and watch this throughout monitoring.
