Please note that the approved instrument, final plan, design plans submitted with the PCN, as well as all applicable general and regional conditions (previously provided) must be strictly adhered to in order for the authorization to remain valid. The 13.15-acre project is located approximately five miles northwest of Swiss in Madison County, North Carolina. The purpose of this letter is to confirm the initial release of credits for this mitigation site. Pursuant to the Mitigation Banking Instrument (UMBI) entitled, Agreement to Establish the RES French Broad 05 Umbrella Mitigation Bank, approved May 30, 2019; the site -specific Puncheon Fork Final Mitigation Plan dated May 22, 2020 and a final plan addendum received September 4, 2020, fifteen percent (15%) of the mitigation site's total restoration and enhancement credits shall be available for sale immediately upon completion of all the following: a. Execution of the MBI by the Sponsor, the Corps, and other agencies eligible for membership in the IRT who chose to execute the agreement. b. Approval of the Final Mitigation Plan. c. The mitigation site must be secured. d. Delivery of the executed financial assurance documents as described in Section IX of the UMBI and Section 13, page 43 of the Puncheon Fork Final Mitigation Plan, dated May 2020 and approved October 2020. e. Recordation of the Corps -approved site protection mechanism described in Section X of the UMBI, and Appendix A of the Puncheon Fork Final Mitigation Plan, dated May 2020 and approved October 2020. f. Issuance of the 404-permit authorization for site construction. By copy of this correspondence, we confirm that you have satisfied the above requirements for initial release for all parcels within the bank; 425.3 SMU's and 0.157 WMU's constituting 15% of the mitigation site's total restoration and enhancement credits are now available for sale. The Corps has already issued a Nationwide Permit 27 (NWT 27) verification letter authorizing work in waters of the United States associated with the restoration and enhancement of aquatic resources for the mitigation bank site. As bank sponsor you are required to comply with the approved RES French Broad 05 UMBI and Mitigation Plan, the terms and conditions of your NWP 27 verification letter, and the Corps' regulations regarding compensatory mitigation (33 CFR 332). The bank sponsor accepts all risk, liability, and responsibility for the success of all mitigation activities associated with the approved mitigation bank site. In accordance with the Final Mitigation Plan, the bank sponsor must prepare and submit annual monitoring reports to document whether the stream and wetland restoration and enhancement areas for the project site meet the necessary interim and final performance standards. When credits are debited from the mitigation site, the bank sponsor must provide the Corps with an updated ledger form identifying the purchaser of the credits, the project name, the permit number, and the number and type of credits to be debited. When all stream credits have been consumed, no more credits may be sold from this mitigation site. Thank you for your time and cooperation.
