Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9,1994 (or as subsequently amended). The following changes were made to the final permit in response to your comment letter of December 19, 2000: ➢ The limits for Lead, Chromium, and Nickel have been deleted. Reasonable Potential Analyses indicated that the maximum predicted levels for these parameters were less than the allowable concentrations. Therefore, fin -its for these parameters are no longer necessary. ➢ Instream monitoring of Fecal Coliform and Conductivity has been deleted. ➢ . The daily max limit for Cadmium was revised from 12.8 to 15 µg/1 as per current Division policy. ➢ The daily max limit for Cyanide was revised from 51.6 to 22 µg/1 as per current Division policy. ➢ Monitoring for Total Nitrogen and Total Phosphorus has been changed to weekly. The results of this additional monitoring will be used in the development of a nutrient management strategy for the Yadkin River Basin. ➢ The limits for ammonia nitrogen were inadvertently changed in the draft permit. We apologize for this mistake and have reinstated your previous limits. If any parts,.measurement frequencies or sampling requirements contained in this permit are unacceptable to you, you have the tight to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, taus decision shall be final and binding. Please note that this permit is not transferable except after notice to the Division. The monthly average effluent BOD5 and Total Suspended Residue concentrations shall not exceed 15 percent of the respective influent value (85% removal). 4. The daily average dissolved oxygen effluent concentration shall not be less than 5.0 mg/l. 5. The pH shall not be less than 6.0 standard units nor greater than 9.0 standard units. 6. Chronic Toxicity (Ceriodaphnia) at 39%: January, April, July & October (see special condition A. (2)). There shall be no discharge of floating solids or visible foam in other than trace amounts. CHRONIC TOXICITY PERMIT LIMIT (Quarterly) The effluerat discharge shall at no time exhibit observable inhibition of reproduction of significant mortality to Cniodaphniui dubia at an effluent concentration of 39%. The permits holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Geriodaphnia Chronic Effluent Bioassay Procedure," Revised February 1998, or subsequent versions or "North Camolina Phase II Chronic %X-1ole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The tests will be performed during the months of January, April, July+and October. Effluent saunpling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit Emit, then multiple -concentration testing shall be performed at a minimum, in each of the two following months as described inn "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. The chronic value for multiple concentration tests will be determined using the geometric mean of the highest concentration having no detectable impairment of reproduction or survival and the lowest concentration that does have a detectable impairment of reproduction or survival. The definition of "detectable impairment," collection methods, ewxposure regimes, and further statistical methods are specified in the "North Carolina.Phase 11 Chronic \thole Effluent Toxicity Test Procedure" (Revised -February 1998) or subsequent versions. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of \Water Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. These comments are a result of my conversation with you as well as a conversation Ms. Carol Rogers, Pretreatment Coordinator, had with Mr. Joe Corporone. Fourth Creek "TP Permit No. NCO031836 K1. Ammonia. We have a concern with the proposed ammonia limits. This is a drastic reduction. No reason for this reduction was given. Mr. Corporone advised Ms. Rogers that these limits appeared to be in error and that the old limits would be reinstated. We would request the old limits be reinstated. y�rr1 ' 2. Cadmium. We believe the weekly limit proposed for Cadmium under the 6-MGD permit to be too low to achieve compliance. We request a higher limit. tX3. Cyanide. The limit for Cyanide is too low. Describe receiving stream features and pertinent downstream uses: The receiving stream is approximately 15-20 feet wide and 1-3 feet deep at the discharge point. The effluent discharge is highly colored and tints the stream for several miles (see also Part IV). Third Creek carries a lot of suspended sediment from stormwater runoff in Statesville. Downstream uses of the surrounding land is primarily agricultural with some undeveloped woodlands. PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS 1. a. Volume of Wastewater: 2 MGD (average flow 1998) b. What is the current permitted capacity: 4 MGD C. Actual treatment capacity of current facility (current design capacity): 4 MGD d. Date(s) and construction activities allowed by previous ATCs issued in the previous two years: 1130197 - The DWQ approved an ATC to construct two belt presses with feed pumps, polymer system and wash water pumps (replaced the existing dissolved air flotation thickener). The construction activities have been completed and the new dewatering system is in operation. 9126196 - The DWQ approved an ATC for the construction of a third influent screw pump. The construction has been completed. e. Description of existing or substantially constructed WWT facilities: The existing WWT facilities consist of mechanical bar screens, influent screw pump station, two extended aeration basins, waste and return pumps, two secondary clarifiers, chlorination basin, an aerobic sludge digester, sludge thickener and a sludge press. f. Possible toxic impacts to surface waters: The facility has several industries which may contribute toxic substances, see permit application for more details. Chlorine is added to the waste stream. h. 'Pretreatment Program (POTWs only): The city has an approved pretreatment program. 2. Residual handling and utilization/disposal scheme: Sludge is currently dewatered on -site and transported to the Fourth Creek WWTP where it is treated for distribution using the N-Viro Soil Process (reduced to a Class A material). The sludge is then taken by area farmers for their use. No contractor is involved. The city also possesses a land application permit (used as backup disposal method) and a landfill permit (the landfill at Third Creek WWTP is no longer used). a. The WWTP appears to be adequate to meet all existing effluent limits and is well maintained and operated. The subject WWTP is a member of the Yadkin Pee - Dee River Basin Association. As a member, all instream monitoring is conducted by the association. However, influent and effluent sampling remains under the control of the WWTP facility. This office has received multiple complaints regarding the colored effluent from this WWTP. Jeff Carty (ORC) stated that the color is primarily attributable to MoCaro Dyeing and Finishing. MoCaro contributes approximately 500,000 gallons of wastewater per day to the plant (25% of the total daily load). The effluent color varies from deep red to purple and noticeably tints Third Creek for several miles downstream. However, there is very little public exposure downstream as the stream is surrounded by farmland and undeveloped woodlands. Most of the complaints have come from observations at road crossings. If quantitative color standards are ever adopted, the effluent from this plant would need to be reviewed. The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *September 1989) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is 39% (defined as treatment two in the North Carolina procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The first test will be performed after thirty days from the effective date of this permit during the months of January, April, July, October. Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. To manage these residuals, the biosolids management policy is to process two-thirds of all residuals produced through the NViro process per Distribution Permit number WQ0006245 and land apply the remaining one-third through a contract operation. The contract for land application was signed on August 19, 1998 and the contractor is in the process of obtaining the land application permits. The City also holds Land Application permit number WQ0014543 which will only be used as a back-up method of residuals disposal. At this time, no residuals have been land applied. All residuals are being processed through NViro. The Third Creek WWTP processes an average wastewater flow of 2.0 million gallons per day. After conventional processing through an activated sludge operation, sludge is aerobically digested and then dewatered using a belt filter press. The press cake is transported to the Fourth Creek Residuals Facility and is blended with biosolids from Fourth Creek and dewatered alum sludge from the water plant. The blended material is stabilized using the NViro process per Distribution Permit number WQ0006245.
