Sullins Dee Freeman Governor Director Secretary November 16, 2010 DWQ Project # 09-0566 Johnston County Mr. Joe Poole Caterpillar 954 NC 42 East Clayton, NC 27520 Subject Property: Caterpillar Access Road Ut to Neuse River [030402, 27-(39.7), WSIV, NSW] STORMWATER MANAGEMENT PLAN APPROVAL Dear Mr. Poole: On May l' 2009, the Division of Water Quality (DWQ) issued a 401 Water Quality Certification to . impact 192 linear feet of perennial stream, 15,004"square feet of Zone I Neuse River basin, protected riparian buffers and 9,770 square feet of Zone 2 Neuse River basin protected riparian buffers. . . In order to meet Condition Nos. 6 and 7 of the 401 Certification, for this project, a stormwater. . management plan for Phase 2A, dated September `10, 2010 was'received by the DWQ on September ,:r WQ. staff during an. 13, 2010. Based on discussions between Caterpillar staff, the consultant aridt) on-site meeting held on September 29, 2010, the stormwater management plan was mod fied.. The second revised stormwater management plan, dated October 12, 2010, was received by the DWQ on October 12, 2010. The third revised stormwater management plan, dated October 27, 2010, was received by the DWQ on October 28, 2010. The signed and notarized Operation and Maintenance Agreement for Phase 2A was received on November 10, 2010. This stormwater management plan for Phase 2A of the Caterpillar Access Road project has been reviewed and satisfies the stormwater management conditions of the 401 Water Quality Certification: You are required to meet the following conditions: The stormwater management system (consisting of three permanent sediment basins to serve Phase 2A and one permanent sediment basin to serve Phase 1 and all associated sediment and erosion control devices including check dams, scour holes, vegetated filters, and level spreaders), all stormwater conveyances and the grading and drainage patterns depicted on the plans, as approved by this office must be maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization from the DWQ. The stormwater management structures shall have maintenance access to allow for the ability to maintain the structures, and to perform corrective actions. All operation and maintenance activities shall be followed as stipulated in the Operation and Maintenance Agreement signed and notarized on November 5, 2010, and received in our office on November 10, 2010. 3. The applicant and/or authorized agent shall provide a completed Certification of Completion Form to the DWQ 401 Program within ten (10) days of the project completion (available at: hq://portal.ncdenr.org/web/wq/swp/ws/401 /certsandpermits/apply/forms).
