Thanks Tammy. My take on the specific non-riparian types would be that it's a permit
decision. If the project manager makes the decision that it's out of kind, then they deny
the use of the bank or raise the ratios. Just my
thought, which is worth about $2.38 and a pocket of lint.

I've been looking at the draft MBI & final mitigation plan (July 2010) for Barra Farms II.
MBI looks fine except for typos in Table 5 (the cumulative percentages are incorrect for
Years 3-6). In Section XIII.I., please have monitoring and other reports sent to Mr. Ian
McMillan, NCDENR-Division of Water Quality, 401 Oversight & Express Permitting Unit, Mail
Service Center 1650, Raleigh, NC 27699-1650.
As a general issue (but one that might effect this bank), we're having heartburn about
lumping non-riparian NC WAM wetland types into one box for mitigation because it allows for
such a broad range of wetlands to be "in-kind" (e.g. pocosin can offset loss of non-riverine
swamp forest). I believe John D has been discussing this with Corps folks (Lekson, et al) so
maybe it's already been resolved. I'll talk with John about it tomorrow & get back to you.
I'm hoping to get the 401 out the door next week.

Here is the updated MBI with AELT identified as the easement holder. I assume there will be
no significant changes to the latest mitigation plan - so I wanted to go ahead and send this
