Skvarla, III Secretary Division personnel have reviewed and approved your application for minor modification of the subject permit. Accordingly we are forwarding the attached modified permit page. Please remove the existing "Effluent Limitations and Monitoring Requirements" page and replace it with the one attached to this letter. This modification changes the upstream sampling site associated with the discharge from its current location to the Pavilion Boulevard Bridge, further upstream on Mallard Creek. This change is being made in the interest of the safety of personnel performing the instream sampling. The new monitoring site should be a safer location at which to access the stream for sampling, as well as providing a suitable representation of upstream conditions. Use of the modified sampling location will become effective immediately. This modification is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please note that this permit is not transferable except after notice to the Division. The Division may require modification or revocation and reissuance of the permit. Quarterly Composite Effluent Notes: 1. Sample locations: Upstream at Pavilion Boulevard and downstream at NCSR 1300 and at NCSR 1304 (Rocky River). Stream samples shall be grab samples and shall be collected 3/Week during the months of June, July, August, and September and 1 /Week during the remaining months of the year. Instream monitoring is provisionally waived in light of the permittee's participation in the Yadkin -Pee Dee River Basin Association. Should the permittee terminate its participation in the Association instream sampling shall immediately commence as stated in this permit. 2. The monthly average effluent CBOD5 and Total Suspended Solids concentrations shall not exceed 15% of the respective influent value (85% removal). 3. For a given wastewater sample, TN = TKN + NO3-N + NO2-N, where TN is Total Nitrogen, TKN is Total Kjeldahl Nitrogen, and NO3-N and NO2-N are Nitrate and Nitrite Nitrogen, respectively. 4. Chronic Toxicity (Ceriodaphnia dubia) P/F at 90%: February, May, August, November; See Special Condition A. (2.) of this permit. THERE SHALL BE NO DISCHARGE OF FLOATING SOLIDS OR VISIBLE FOAM IN OTHER THAN TRACE AMOUNTS. CHARLOTIE . Bridge where the creek passes under the roadway. Our Laboratory Services Division recently reported that one of our sampling technicians slipped and fell on the creek bank at our current upstrIeam monitoring location. As a result of this accident, we are requesting a change in our monitoring location. Please see the attached maps to reference the current upstream monitoring location and the proposed new monitoring location on the Pavilion BLVD. Bridge. In addition, per the NPDES Units request, we had Donna Hood with the Mooresville Regional office visit this location. Donna felt that the proposed site was an acceptable upstream monitoring location and agreed that it would be a safer location to conduct in stream monitoring.
