Division of Water Resources' Central and Regional staff has reviewed the application package
received September 30, 2020. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on January
22, 2021.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through C, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete.
Please reference the subject application number when providing the requested information. All
revised and/or additional documentation shall be signed, sealed and dated (where needed), with two paper
copies and one electronic copy submitted to my attention at the address below.

A. Application:
1. Section III.1. of the Non -Discharge System Renewal form (FORM: NDSR 01-20) requires a site
map in accordance with 15A NCAC 02T .0105(d) that provides the following information:
a. Legend, north arrow, and scale
b. Distance measurements verifying all setbacks are being met
c. Stormwater drainage controls
d. Location and ownership of property boundaries within 500 feet of the disposal area (including
road/rail right-of-ways)
e. All facility -related structures and fences within the treatment, storage, and disposal areas
f. All habitable residences and places of assembly within 500 feet of all treatment, storage, and
disposal sites
g. Topographic contour intervals not exceeding 10 feet or 25 percent of total site relief
h. Soil mapping units on all disposal sites
i. Location of all wells, streams (ephemeral, intermittent, and perennial), springs, lakes, ponds,
ditches, and other surface drainage features within 500 feet of all waste treatment, storage, and
disposal site(s)
j. Location and identification of each monitoring well (identify any background/upgradient wells)
k. Latitude and longitude coordinates of all monitoring wells (decimal degrees to 6 digits)
1. Location and identification of major components of the waste disposal system
in. Identification of all storage or treatment earthen structures that are part of the permit
n. The wetted perimeter of all irrigation/infiltration fields with field names (named according to the
approved permit)
o. The delineation of compliance and review boundaries
p. 100-year floodplain (if applicable)
The site map submitted does not show the components of the reclaimed water irrigation fields.
Please provide an updated site map.
2. Section VI.L of FORM: NDSR 01-20 indicates that there are no easements. However, the coordinates for
the reclaimed water fields in the permit are shown to be located on parcel number 8030-19-9824 owned by
Paasch Developments, LLC. In accordance with 15A NCAC 02L .0107(f), if the permittee is not the
owner of the land within the compliance boundary, the landowner of the land within the
compliance boundary shall execute and file in the Register of Deeds in the county in which the
land is located, an easement running with the land which:
a. contains:
i. either a notice of the permit, including the permit number, a description of the type
of permit, and the name, address and telephone number of the permitting agency; or
ii. a reference to a notice of the permit with book and page number of its recordation if
such notice is required to be filed by statute;

b. prohibits the construction and operation of water supply wells within the compliance
boundary; and
c. reserves the right to the permittee and the State to enter on such property within the
compliance boundary for groundwater monitoring and remediation purposes.
As such, an easement shall be provided meeting these requirements, executed by Paasch Developments,
LLC, and recorded in the Currituck County Register of Deeds. Please also note that this easement would
need to cover all parcels which has reclaimed water irrigation. It appears that there are additional golf course
holes located on parcels 8031-41-8248 and 8031-53-1728 also owned by Paasch Developments, LLC which
potentially have reclaimed water irrigation fields.
The wet weather storage/irrigation pond is located on land not owned by the Permittee, as the northeast
corner of the pond is located on parcel number 8030-19-9824 owned by Paasch Developments, LLC.
Storage structures have a setback of 50 feet to the property line. In order for this pond to meet setbacks, a
setback waiver shall be written, notarized, signed by all parties involved and recorded with the county
Register of Deeds in accordance with 15A NCAC 02T .0506(d) allowing a reduced setback of 0 feet from
wastewater storage units to property lines. As the pond is located on land not owned by the Permittee, the
Permittee shall also provide a reciprocating waiver allowing the storage unit within 0 feet of their property
line as well. Prefilled waivers have been provided with this letter.
B. Groundwater Monitoring Program:
1. Upon review of the effluent flows from the WWTP against the amount of water irrigated out of the
wet weather storage/irrigation pond, there are concerns that this unlined pond is acting as an
infiltration pond. As such, monitoring wells shall be provided around this pond to evaluate any
potential effects on surrounding groundwater.
The Division requests that the Permittee propose a monitoring well system to evaluate the
groundwater surrounding this pond. These proposed well locations shall be included on the site
map submitted in Item A.1. of this request, and this program shall be approved by the NC DWR
Washington Regional Office so that the wells can be included in this permit issuance. A map with
proposed well locations is attached to this letter.
C. Existing Permit:
1. Condition III.27. states that the Permittee shall be responsible for the operation and maintenance
of the 6,000 GPM stormwater pump to allow movement of groundwater off site from the golf
course, and maintain the canals for positive drainage until such time that the County has established
a drainage district. Please provide an update on the county drainage district. If not established, what
actions have been done to maintain positive drainage.
