I hope this answers your questions. I’m forwarding you the email from him. The portions of the project that are generating buffer mitigation credits are not in the vicinity of the DOT road or crossing so Dave should only review it as an impact to buffers. Hope that helps. Let me know if you need anything else from me for this project. Beth. All the buffer credits on the site are quite far from the DOT impact area (at least 2,500 feet away). I don’t know if it’s relevant or not, but he buffer part of the project also closed out last year. Hope this answers your question. Thank you! Jeremiah From: Harmon, Beth Sent: Wednesday, December 16, 2020 11:29 AM To: Dow, Jeremiah J <jeremiah.dow@ncdenr.gov> Subject: FW: 17BP.7.C.17 Sockwell Road Pipe Replacement Hi Jeremiah – Got a situation on the Agony Acres. This is something that has gone on for a while and I need some confirmation from you. We know that DOT was impacting some of the stream mitigation credits associated with the Agony Acres site and it has already been accounted for in CRM (SEG-01560) which is enhancement II. DOT Division 7 is working on getting the permit and DWR is having issues and wants to verify if there is any buffer mitigation at the same 2 impact site. Can you look at the project and let me know if there are any buffer credits that we are claiming at this same site? Hope that makes sense. Please let me know if you require any additional information. Thanks! Beth. Ok, we are going back a bit for this one – you previously issued me a DMS acceptance letter for the above project, however, it only included stream impact. This Division pipe replacement is encroaching into the Agony Acres mitigation site, so Division 7 will owe you all for the buffer impacts as well. I attached the overlay map I worked up previously which lists out the Zone 1 and Zone 2 impacts (1,190 sq. ft. and 207 sq. ft. respectively). Can I ask you for a revision to the attached letter to include the buffer as well? I’m sorry I didn’t catch it before. I’m dusting this puppy off and hoping to get it off my desk. Thanks so much. I included Tim on this email as well; he’s been my POC since this landed in my lap and I want to keep him in the loop in case I miss anything. Take care! Nik Nicole J.
