The Division determined that the restoration work within the impacted stream channel and wetland had been completed as approved. Please note that until all areas of repair adjacent to this channel are stabilized with vegetation, they have the potential to contribute additional sediment deposits into protected areas. Until the adjacent and upland areas are completely stabilized with vegetation, the Permittee will be responsible for any future sediment deposited within the restoration area and/or downstream of the area. In addition, the Division is in receipt of Engineering Certifications for the following Stormwater BMPs: Bioretention Cells #2 and 93 and Infiltration Trenches #l, 42 and #3. The Division acknowledges that occupancy of buildings with stormwater drainage to any of these certified BMPs will now be in compliance with permits issued by this agency. Please note that occupancy of other buildings or impervious surfaces requires certification of the remainder of the approved BMPs. In addition, future inspection and maintenance of these measures remains the responsibility of the Permittee and failure to do so may result in future permit violations. This Office is considering sending a recommendation for enforcement to the Director of the Division of Water Quality regarding these issues and any future/continued violations that may be encountered. These violations and any future violations are subject to a civil penalty assessment of up to $25,000.00 per day for each violation.
