So because the site is not located in a trout watershed, you are below notification thresholds for the bank stabilization
work under NWP #13 (which is 500-feet) and if you reduce the piping impact to 60-feet on the trib then you would also
be below notification thresholds for the NWP #18.

Amanda,
Thank you for meeting with me on site yesterday. Can you please confirm that a NWP 18 can be used for the reduced
linear footage of piping (-60 liner feet of impact) at the Sunbelt site and that a PCN is not required? Below is
information I copied from the USACE Wilmington Website:
"4.9 NWP #18 — Minor Discharges
4.9.1 This NWP may not be used in conjunction with NWP #14 to create upland.
4.9.2 In designated trout waters (see Regional Condition 2.7), a PCN is not required if 1) the quantity of discharged
material is less than or equal to 10 cubic yards below the plane of the ordinary high water mark, 2) temporary impacts to
streams or waterbodies associated with dewatering to work in dry conditions are 150 linear feet or less, and 3) the
activity will be constructed outside of the trout waters moratorium (October 15 through April 15)."
It appears that all the conditions listed can be met. I will copy you on our reply to Andrew's Request for Additional
Information.
