Please refer to the Proposed Condition Sheet 3 in the attached plan. We will be installing a culvert and headwall near the river -left top of bank for sweeten creek at approximately Station 1+25 (in the UT about 70 feet upstream of the confluence). We are not proposing to culvert any of the UT upstream of the culvert inlet/headwall and will only be backfilling a maximum of 70 linear feet of the UT downstream of the headwall, between it and Sweeten Creek. Our original plan did show culverting up to 142 linear feet, however during the site visit with Andrew and Andrea it was determined that we could reduce that impact. I understand that the work in Sweeten Creek will be permitted through a NWP #13 and work in the UT under a NWP #18. Please give me a ring if we need to discuss in more detail. Looking at the latest plans, it appears you are piping approximately 70-If of the channel and then back filling the remainder which is why I'm saying the entire length is being counted as impact. Andrew, Please find attached a revised plan set that includes the reduction of culvert proposed in the UT to Sweeten Creek (Sheets 3 & 8). Additionally is has been confirmed that a Nationwide 18 will be used to permit the referenced culvert impacts. Please let me know if I can provide any additional information. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. During a site visit conducted December 7, 2020, it was discussed and determined that a portion of the culvert proposed to be installed on the unnamed tributary of Sweeten Creek could be avoided. Please provide updated plans reflecting the reduction in impacts. [15A NCAC 02H .0502(a)(9) and 15A NCAC 02H .0506(b)(2)] 2. Please confer with the US Army Corps of Engineers to determine the appropriate permit the proposed culvert impacts may be verified under and notify the Division of the determination. [15A NCAC 02H .0501(b)(2)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received by January 13, 2020, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee.
