Dear Mr. Huffman:
Reference your April 15, 1993 application for Department of the Army
authorization to dredge approximately 5500 cubic yards of silt in front of the
Buck Steam power station intakes at High Rock Lake, near Spencer, in Rowan
County, North Carolina. The purpose for the project is to clear intake
tunnels to allow refurbishment of trash racks. The silt excavation will be
done with a hydraulic dredge with all excavated material being deposited on a
contained, high ground location. No wetlands will be impacted by the project.
For the purposes of the U.S. Army Corps of Engineers' Regulatory Program,
Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the
Federal Register on November 22, 1991, lists nationwide permits.
Authorization, pursuant to Section 404 of the Clean Water Act, was provided
for return water from an upland, contained dredged material disposal area
where the quality of the return water is controlled by the State through the
section 401 Certification procedures. Please contact Mr. John Dorney of the
State at (919) 733-1786 to obtain the required water quality certification or
a waiver of certification.
Your work is authorized by this nationwide permit provided it is
accomplished in strict accordance with the enclosed conditions. This
nationwide permit does not relieve you of the responsibility to obtain any
required State or local approval.
This verification will be valid for 2 years from the date of this letter
unless the nationwide authorization is modified, reissued, or revoked. Also,
this verification will remain valid for the 2 years if, during that period,
the nationwide permit authorization is reissued without modification or the
activity complies with any subsequent modification of the nationwide permit
authorization. If during the 2 years, the nationwide permit authorization
expires or is suspended or revoked, or is modified, such that the activity
would no longer comply with the terms and conditions of the nationwide permit,
activities which have commenced (i.e., are under construction) or are under
contract to commence in reliance upon the nationwide permit will remain
authorized provided the activity is completed within 12 months of the date of

the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify,
suspend, or revoke the authorization.

Upon review of your request for 401 Water Quality Certification to place fill material in
waters which are tributary to Yadkin River for return water from an upland diked disposal site
located at Buck Stream Station on Dukeville Road in Spencer in Rowan County, as described
in your submittal dated 20 April 1993, we have determined that the proposed fill can be
covered by General Water Quality Certification No. 2668 issued January 21, 1992. A copy of
the General Certification is attached. This Certification may be used in qualifying for
coverage under Corps of Engineers' Nationwide Permit No. 16.

WATER QUALITY SECTION
In order to facilitate refurbishment of the intake trash racks and
to eventually allow restart of two units, Duke Power Company
intends to dredge approximately 5500 cubic yards of silt (mostly
yellow/brown micaceous material of a sandy/fine texture) from in
front of Buck Steam Station on the Yadkin River. Dredging will be
done by suction dredge with a cutter head and all the material will
be pumped to the station ash basins for settling. The total
surface area of the ash basins is 62.5 acres. All water associated
with this dredging effort will be returned to the Yadkin River
through an NPDES controlled outfall (NPDES Permit # N00004774.)
There will be no wetland impacts associated with this activity. In
addition, approximately 600 cubic yards of material will have to be
removed from the intake tunnels by divers using air lances. Due to
the confined space of these tunnels, we have no alternative but to
flush this material to the river. This portion of the overall
effort will be performed after the dredging, i.e. late in the
summer and should, therefore, have no effect on any fish spawning
in the area.
Accordingly, we are applying to the US Army Corps of Engineers for
coverage under Nationwide Permit #16 of the dredging, the terms and
conditions of which we believe this activity to meet, and we are
applying to your office for General 401 Certification concurrence
regarding the above activities. We have also notified the SHPO and
the US Fish and Wildlife service of our intention to carry out this
activity. As we anticpate performing this dredging sometime in the
June-July time frame of this summer, your prompt review of this
application would be greatly appreciated.

Attached are seven copies of the Joint Application Form for
Nationwide Permits in NC as well as a section of the USGS Salisbury
Quad and a copy of the original construction excavation plan in
front of the intakes. We intend to restore the area to this plan
as much as is possible.

Historic Presevation Officer of this activity as well as applying
to the US Army Corps Asheville Field office for NWP verification
and to the NC Division of Environmental Management for blanket 401
Certification concurrence. We anticipate carrying out this
activity sometime in the June-July timeframe of this summer (1993.)
