HomeMy WebLinkAbout20070812 Ver 2_Settlement Package_20060427 April 27, 2006 ALCOA-YADKIN SETTLEMENT PACKAGE • Provide 1000/2000 cfs average daily flow to Progress Energy to meet instream flow needs below Blewett Falls. • Participate with Progress Energy to produce two downstream flow normalization periods each year during spring anadromous species spawning period. • High Rock Lake to be managed at 4' drawdown limit for April 1 thru Oct 31 and 10' maximum for November 1 thru March 31. Plus normally a 6" buffer above this limit. • Reservoir drawdown restrictions for other three impoundments satisfactory to adjacent property owners. . • Voluntary reservoir stabilization period during spring spawning. • Low Inflow Protocol (LIP) to manage reservoir levels and releases. • Make approximately 1400 acres of land for Morrow Mtn. S.P. expansion available for purchase by DENR at fair m- arket.value. • Protect approximately 2400 acres of land on east side of Tuckertown reservoir as gamelands and for other recreational uses for term of license through lease to WRC and Davidson County. • Protect additional conservation lands previously identified by APGI and others round High Rock Lake and upstream along the Yadkin River through conservation easements or other means. • Shoreline Management Plan approved by FERC in 2/2004 would continue under new license. This protects the following amounts of each reservoir's shoreline in "conservation zones": High Rock 33% (119 miles); Tuckertown 65% (49 miles); Narrows 47% (54 miles); and Falls 91% (5 miles). Private access facilities are not permitted on Tuckertown and Blewett Falls reservoirs. • Water quality enhancements for turbine releases. • Recreation enhancements. • Maintain and enhance the existing swimming areas developed by APGI on the project reservoirs for the term of the new license. . • Develop and maintain a new recreational area including a public swimming area on High Rock Lake in Rowan County for the term of the new license. • Upgrade all four portage trails around the Project's dams to State standards within 10 years of issuance of the New License. • DENR to support a longer term license not to exceed 40 years. DENR would support a 50-year license if the following modifications were made in addition to all of the above components: Protect approximately 2400 acres on the east side of Tuckertown Reservoir by selling them at fair market value to WRC and Davidson County for use as gamelands and for other recreational uses.
