T Raleigh, NC 27699 Re: APGI Responses to NCDWQ Questions about Yadkin Project DO Enhancement During Generation Unit Refurbishment/Upgrade Dear Ms. Kucken, I am writing in response to questions that were raised by you and Mr. John Dorney at our meeting on May 24, 2006 to discuss the Yadkin Project relicensing, and more specifically, APGI's proposed DO enhancement and unit refurbishment/upgrade program. I apologize for the time it has taken to get back to you with responses, but we have been focused on the relicensing settlement negotiations and completing an Agreement in Principle for delivery to stakeholders. At our meeting on May 24, NCDWQ asked APGI to respond to several important questions: 1) Regarding the operation of the Narrows development, what portion of the time does APGI run 1, 2, 3 or 4 units at Narrows during the May - November time frame? 2) Regarding the proposed refurbishment/upgrade schedule: a. Can APGI shift the refurbishment of Narrows Unit 2 up to be completed in 2007, thereby allowing the refurbishment of the other Narrows and High Rock units to all be shifted forward a year? b. Why does APGI require 2 years to complete the engineering studies for Narrows, before unit refurbishments can be done? 3) Regarding the information in support of the proposed schedule, can APGI provide additional engineering information for the files that supports the proposed refurbishment/upgrade schedule? 4) Regarding the High Rock TMDL Process, can APGI provide NCDWQ with a copy of its letter committing funds to the TMDL sampling efforts? In response to your first question about the portion of time that the Narrows development operates with 1, 2, 3 or 4 units during the May - November timeframe, operational records since 1/1/2001 indicate the following percentages: 0 units 27%; 1 unit 27%; 2 units 9%; 3 units 11%; and 4 units 26%. This doesn't answer our 11 question really. I was looking for the percentage of time EACH unit operated and WHICH units were being operated. I can't tell by the answer if they are operated as Unit 1 then 2 then 3 then 4 In response to your questions about the proposed refurbishment/upgrade schedule, we have prepared a more detailed version of the schedule (see attachment) that reflects much more of the engineering and testing work that has to be done as part of the refurbishment program, before units can actually be upgraded. As you can n see, although there are no unit refurbishments/upgrades planned for 2007 and 2008, APGI does have an extraordinary amount of preliminary engineering iesZltt? ??'? and tests that have to be completed in this timeframe. In short, these are not idle years. I don't think this answers our questions either. Also regarding the attached, revised refurbishment/upgrade schedule, we have adjusted the dates for the refurbishment of the units at Tuckertown and Falls to match the Proposed Plan shown in Attachment 1 of our March 31, 2006 letter to NCDWQ. The previous schedule (Attachment 2 of the March 31 letter) had not been updated to reflect those changes. The work at Falls seems to be convenient for them, but doesn't address the actual concerns likely to present themselves at Tuckertown (measured low DO ). This schedule essentially looks like we are willing to allow them to do what makes business sense (assumed) over addressing water quality standards. Regarding additional engineering/design information that can be provided to NCDWQ in support of the proposed schedule, APGI is willing to submit to NCDWQ any relevant engineering studies or information done by APGI or its engineering consultants as this work progresses. However, APGI considers all such information as proprietary, business sensitive information that would have to be protected as such by DWQ._ You noted this in your letter to them Finally, in response to your question about APGI's participation in the High Rock TMDL process, I recently e-mailed to you APGI's commitment to the planned water quality monitoring effort which is being done to support model development for the TMDL process. Attached is a hard copy of that email. The $50K commitment is great. They have put this kind of money and more on other local things such as boats for patrolling the lakes etc Once again, we hope this letter provides you with the additional information that you were seeking.
