Based on our phone conversation on November 1, 2010, the impacts from the proposed road improvement project are cumulative with the 211/Midway Commercial Center Project, and stream impacts will exceed 150 If, and will require a $570.00 application fee. Therefore, I am returning the original check for $570.00. Also, W&R identified an error in the calculations for the wetland impacts. Approximately 23 sq ft of wetland impacts from rip-rap was not included in the original impact calculations. Due to the small increase of wetland impacts, the 0.16 acres of wetland impacts requested has not changed and the Wetland Impact Table has not been revised. The Wetland Impact Map Summary and Figure C have been revised and have been enclosed with this letter. Also, I am providing a copy of our response to the Corps Request for Additional Information for your consideration in review of the PCN. The review comments and our responses (shown in blue) are as follows: 1) Please explain why the road cannot be widened to the north of or symmetrically along Highway 211. Widening to the north of or symmetrically along 211 would avoid and/or minimize impacts to wetlands B and C. The roadway has been widened to the north side to avoid wetlands along the owner's project frontage where feasible. However, the portion of the road widening along NC 211 just east of the Midway Road intersection is for adding a second eastbound lane to accommodate the proposed southbound dual left turn lanes from Midway Road. Shifting the roadway to the north in this area to avoid wetlands is not feasible or practical since any shifting of the roadway in this section would result in travel lanes to be misaligned between the west and east side approaches of the intersection. In essence, avoiding the wetlands would require the entire intersection to be relocated to the north, which would require an extreme increase in construction costs, as well as significant impacts to other adjacent properties, one of which was just recently improved following the NCDOT TIP project along Midway Road and Middleton Avenue. In addition, there will eventually be the need for additional westbound lanes along NC 211 following additional development of other properties around the NC 211/Midway Road intersection. Therefore, the right of way area available north of existing NC 211 will be needed to accommodate those additional lane(s) in the future. 2) Please justify the wetland impact associated with the placement of rip-rap along the eastern edge of wetland C. Please explain why the rip-rap cannot be placed at the outlet of the 18" RCP outside of the wetland areas. Please provide revised plans showing the rip-rap placed outside of the wetlands. The existing driveway pipe requires relocation due to the road widening along NC 211 and the new 18" RCP is the same length as the existing pipe to be removed. Rip rap is proposed at the downstream end of the 18" RCP to reduce water velocity and dissipate energy at the pipe outlet, which will greatly reduce chances of erosion within the upper wetland limits. However, since the wetland limits extend all the way to the toe of slope at the existing driveway the proposed rip rap can not be shifted outside the wetlands unless the existing private driveway is shifted further to the east. Shifting the driveway would require permission and/or additional easements from the landowner. It would also increase construction costs and require an additional driveway permit from NCDOT. Therefore, we respectfully request this small wetland impact (39 sf) to be permitted by the USACE and the impact maps have been modified accordingly to include the impact as previously shown. 3) Please provide cross-sections of the impact areas. The cross-section should show the grade of the fill slopes and compare the proposed elevations of the fill areas to the elevation of existing grades. Culvert drawings have been provided as requested. 5) In accordance with regional condition 3.6 of the nationwide permits, culverts greater than 48 inches should be buried one foot below the bed of the stream. Please provide culvert drawings that depict the culverts and the depths they will be buried. A waiver from the depth specifications can be requested in writing if you can demonstrate that the burial of the culvert would result in more environmental damage, like channel destabilization, head cutting, etc. Culvert drawings have been provided as requested. Please note this project includes extension of two existing box culverts along NC 211. The box culverts are being extended at the existing longitudinal grade, therefore, the depth of bury will solely depend on the existing culvert slope and elevations and their relationship to the existing stream channel grades. We trust these responses satisfactorily address the review comments provided by the US Army Corps of Engineers. Please feel free to attach this memorandum with your formal response letter.
