PROJECT DESCRIPTION The project site is located at 18 Sandy Point on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel south approximately 0.5 miles. Turn right onto Sandy Point, travel approximately 0.2 miles to the destination on the right. The property is located on a man-made finger of upland on a man-made canal adjacent to Banks Channel and Middle Sound on the southern end of Figure Eight Island. The 0.34 acre parcel has an existing single family residence and is approximately 5' above normal high water (NHW). Upland vegetation on the property currently consists of ornamental landscaping and lawn grasses. The approximately 105 linear feet of shoreline frontage is currently stabilized by a timber bulkhead with NHW approximately 12' waterward. Additionally, a band of Coastal Wetland ranging from 17' to 25' wide exists waterward of the bulkhead and descend quickly into open water. The applicant currently maintains an existing private docking facility. A fixed pier extends east from the bulkhead into the man-made canal, measuring approximately 32' in length by 6' in width, terminating in a 12' by 12' L-head platform. An access ramp extends from the platform onto a floating dock, positioned perpendicular to the bulkhead, measuring approximately 16' in length by 8' in width. A boatlift, measuring approximately 13' by 13' is located on the northern side of the floating dock. General Permit No. 77858-D authorized the boatlift in an existing slip. No permit history was found for the docking facility; however, aerial imagery indicates the facility in the current configuration existed prior to 1993. The existing docking facility currently accommodates up to two (2) vessels. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion at the property as Conservation. The waters of this canal, Banks Channel, and Middle Sound are classified SA-ORW by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to add a second ramp to a new 8' by 32' floating dock for a total of 3 slips. The proposed 8' by 32' floating dock would be accessed using a new ramp that would be located on the north side of the 12' by 12' L-Head platform. The new floating dock would be installed perpendicular to the shoreline, on the north side of the existing boat lift. According to the applicant the proposed floating dock would provide further access to the boatlift and additional dockage (see Drawing 1 of 2). Water depths on the application and confirmed by DCM, are -3 normal low water (NLW) on the landward side and approximately -6 NLW on the waterward edge of the proposed floating dock. 10. ANTICIPATED IMPACTS As proposed, the new floating dock and boat lift would result in the incorporation of approximately an additional 256 ft2 of Public Trust Area and Estuarine Waters. The project area consists of open water, and there would be no impact to vegetated wetlands or to the high ground area. No encroachment of the15' riparian set back or pier headline is anticipated. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction. If this agency does not render a permit decision within 70 days from December 9, 2020, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of- way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
