This request was submitted in a letter received by DCM on June 30th, 2020 and with the submission of two (2) revised drawings, labeled "Site Location and Plan View", and "Pier and Dock Detail", dated as received by DCM on November 17, 2020. The applicant was issued State Permit No. 80-19, which was originally issued on October 4, 2019 for the construction of a 10 slip marina and gazebo pier on the Carolina Beach Yacht Basin. State Permit No. 80-19 is due to expire on December 31, 2022. The applicant is requesting a minor modification to the permit to allow for a waterward shift in the proposed docking facility, and to add three boat lifts within permitted slips. According to the submitted materials, the applicant is requesting to shift the facility further outwards due to the potential for shoaling to the north of the permitted facility. The original submission requested a shift waterward 75' to the cast, but that proposal was found to be inconsistent with the pier head line. The revised drawings submitted by the applicant request a 33' waterward shift to the east as suggested by DCM Major Permit Staff. The marina's location would be consistent with the local pier head line and would be landward from the USAGE Federal Navigation Channel Setback. The proposed waterward expansion would lengthen the overall length of the fixed pier by 33'. The applicant is also proposing to install either floating lifts or piling based lifts in three slips (Slip #4, Slip #7, and Slip #10). The applicant has notified the adjacent riparian property owners and certified mail green cards were received. The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6), which includes the specific use standards for piers and docking facilities. This office has no objection to the modification of State Permit No. 80-19, provided it is consistent with all other local, state, and H QD. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 5) The authorized covered gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Lattice is specifically excluded from being used under this authorization. 7) The roof of the covered gazebo shall not be designed for second story use. 8) This permit authorizes a maximum of ten (10) formalized boat slips. 9) The authorized structures and associated activity shall not cause an unacceptable interference with navigation, and shall not exceed the footprint as depicted in the attached workplan drawings. 10) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. General 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) This permit does not authorize the interference -with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
