Ronalter, Manager 155 West New York Avenue, Suite 200 Southern Pines, NC 28387 Subject Property: Dollar General - NC211 (After The Fact) REQUEST FOR MORE INFORMATION Dear Mr. Ronalter, DWQ Project # 10-0743 Brunswick County On September 9, 2010, the Division of Water Quality (DWQ) received your after the fact application to impact 0.49 acres of 404 wetlands to construct a Dollar General store on your property. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or waters on the subject property. Therefore unless we receive five copies of the additional information requested below at the DWQ central office, we will have to recommend moving towards denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please provide a Stormwater Management Plan as required by Water Quality General Certification 3821 (#12). This requirement may be satisfied by obtaining a State Stormwater Permit from the DWQ. 2. Since compensatory mitigation will be required by the U.S. Army Corps of Engineers for this project, provide a copy of the acceptance letter from a private mitigation bank or from the North Carolina Ecosystem Enhancement Program (NCEEP) once it is received. 3. The DWQ received new information via email on October 21, 2010, from your consultant describing your intentions to provide further avoidance and minimization of impacts on this site. Please revise the application and provide updated site plans to reflect any changes in regards to this new proposal. 4. At a minimum, DWQ requires that deed notifications be recorded for all retained jurisdictional waters as required by Water Quality General Certification 3821 (#17). A sample deed notification can be found on the DWQ 401 Water Quality Certification web site and the USACE language is found on their website. Please provide a Draft copy that includes the proposed preservation language that will be recorded to accomplish this. If we do not receive the above requested information within 30 calendardays of the date of this letter, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
