Jacksonville Project # 10 0842 Onslow County Dear Mr. Silvester: This Office has reviewed your Pre-Construction Notification (PCN) application dated October 5, 2010 for the fill of 404 wetlands for road crossing within your proposed subdivision. The DWQ has determined that your application was incomplete as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H.0506 and will place this project on hold as incomplete until we receive this additional information. Please provide all of the following information so that we may continue to review your project. 1. The DWQ requests that you avoid additional impacts to the 404 wetlands in the crossings (they are awfully wide). You must show that you have avoided and/or minimized to the greatest amount practicable. 2. Please provide a draft copy of the deed restriction for the remaining wetlands on the property. 3. In the application, under stream impacts, David Bailey of the USACE and I agree that these features are most likely just ditches (tributaries) dug through wetlands and should be counted as area and not in linear feet. Please modify the application accordingly (remove the impacts from under streams and place the impacts under the wetland impacts section). If you would like to have a meeting where you can meet with the agencies and discuss our concerns. Please do not hesitate to call Cameron Weaver to have him arrange it at 910.796.7427. Please reference the DWQ Project # of 2010 0842 in all future correspondence. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers.
