Sullins Director Subject: NOTICE OF INSPECTION Trailwood Section II and III Permit No. SW8 020110 and SW8 041030 Onslow County Dear Mr. McCotter: Dee Freeman Secretary On March 8, 2010, Angela Hammers of the Wilmington Regional Office of the Division of Water Quality (DWQ) inspected Trailwood Section II and Trailwood Section III in Onslow County to determine compliance with Stormwater Management Permit Number SW8 020110 and SW8 041030, respectively. DWQ file review and site inspection revealed that both sites are compliant with the terms and conditions of each permit, respectively. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter for each permit. Please be advised that you are required to comply with the terms, conditions and limitations of your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including operation and maintenance of your permitted stormwater system. If the project has changed name, ownership or mailing address, a formal change of name/ownership form must be submitted to DWQ within 30 calendar days detailing the change. Please provide the name, mailing address and phone number of the person or entity that is now responsible for this permit. Please be advised that violations of your Stormwater Management Permit may be subject to the assessment of civil penalties of up to $25,000 per day per violation. The report summarizes the findings of a recent inspection of the project's stormwater controls conducted on May 19, 2009 to determine compliance with Stormwater Permit Number SW8 041030 issued on December 14, 2004. As indicated in the attached inspection report the following deficiencies must be resolved: 1. Repair swales that do not meet the criteria of the approved plan including negative slopes and vegetation. 2. Perform maintenance necessary to bring swales into compliance with the approved plan. Please inform this Office in writing before June 26, 2009, of the specific actions that will be undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the requested information, when required, may initiate enforcement action includingthe assessment of civil penalties of u to $10,000 per day. If a written plan of action inot submitted to this office by June 26, 2009 then DWQ staff will re- inspect the site and issue a Notice of Violation if the listed deficiencies have not been addressed.. For Trailhead Section II and III, the transfer of ownership request form was signed by Mr. James E. McCotter as the signing official for both the current permit holder as a representative for Swans Builders, LLC and the president of the Trailwood HOA. For Shetland Farms, the transfer of ownership form was signed by Mr. Doyle Evans as the President of both Swans Realty, Inc. and the Shetland Farms Property Owner's Association. DWQ cannot accept a transfer from a current permittee to the same person acting as the HOA president. Re: Trailwood, Section II: #SW8 020110 In regards to the deficiencies noted: A) The swale between lots 17 & 18, Rip Rap is sporadic in the upper reaches of the Swale. This appears to have been placed to stabilize the area. The swale is stabile and functioning. It has at least 100' of 5:1 Swale beyond the Rip Rap prior to daylighting to overland sheet flow and approximately 140' of overland sheet flow before becoming concentrated flow at the natural drain at the corner of lots 16, 17, & 20. Your attorney's cover letter indicates that he had spoken to Ed Beck about the transfer process in July, however, Mr. Beck does not have any specific recollection of speaking to him. It is the Division's policy not to transfer permits from the permittee (as the developer), to the same permittee as an officer in the HOA unless and until the permittee/developer is no longer affiliated with the HOA, holds no office and has no majority vote in the HOA based on the number of votes allowed per lot that remain in the permiftee's possession. It is customary to assign more votes per lot to the lots that.are owned by the developer or permittee, so it may take more than 50% of the lots to be sold to get to the ooint where the permittee no longer has a majority vote. AS an alternative, the Division will transfer the permit to the HOA wflen 50% of the lots or less are sold if a secured bond is provided, where there will be money available to the HOA to make any necessary repairs to the stormwater system after the developer no longer has any interest left in the project and the homeowners are truly the ones left with the permit responsibilities of operating and maintaining the sJystern:.................... _ Additionally, it appears that Section I (SW8 020912) contains a curb outlet Swale system, ys however, the required curb outlet supplement, swale calculations and drainage area delineation were not provided as part of that application. The permit was apparently erroneously issued without these items. I am requesting that the missing items be provided prior to transferring the permit for Section I. Prior to transferring the permit for Section II, a new curb outlet supplement must be signed and submitted. Each curb outlet supplement should be signed by the HOA.
