REQUEST FOR MORE INFORMATION
Dear Sirs:
On January 30, 2007, the Division of Water Quality (DWQ) received an application fora 401
Water Quality Certification (WQC). This application was for authorization to impact 120.5
linear feet of stream as well as stream and riparian buffer restoration. On February 21, 2007,
DWQ received additional information supporting your original application.
A DWQ file review indicated that this project is the subject on an enforcement action (Case No.
SS-2006-0001) that has been contested and will be scheduled for hearing in the Office of
Administrative Hearings. It is the understanding of DWQ staff that you may with to discuss a
settlement regarding this matter. Please note that the information regarding plantings, reports
and monitoring maybe altered or detailed further than the information included in your 401
WQC application to settle this case.
The DWQ will require additional information in order to process your application to impact
wetlands and/or streams on the subject property. Therefore, until we receive the additional
information requested below, we will place this project on hold. Please provide the following
information.
Additional Information Requested:
1. Please explain whether you wish to discuss settlement with respect to the enforcement
action. If so, this settlement will influence the project as proposed in your application and
the project will remain on hold until the completion of settlement discussions.

2. Please provide information on current restoration efforts, plantings, and respective
restoration costs.
Please respond within four (4) weeks of the date of this letter by sending the required
information to the attention of Danny Smith of the Non point Source Assistance and Compliance
Oversight Unit of the Division of Water Quality 1617 Mail Service Center, Raleigh NC 27699-
1617. Also, Nancy Dunn of the Attorney General's Office will be contacting you in an effort to
formally determine if you wish to discuss settlement options or go forward with scheduling a
hearing.
It is this Office's understanding that you are trying to resolve water quality violations that have
occurred at the subject tract. This letter and information request is intended to help develop a
solution to this matter.
This letter only addresses the application review and does not authorize any impacts to wetlands,
waters or protected buffers. Please be aware that any impacts requested within your application
are not authorized at this time by the DWQ. Please call Danny Smith at 919 733-5083 ext. 353 if
you have any questions or would like to set up a meeting to discuss this matter.
