On behalf of MDI Management, Inc we are requesting Corps authorization to utilize a NWP 14 for 0.16 acres of
permanent wetland impacts and 43 if of permanent stream impacts as a result of the proposed road
improvements. We are also requesting 401 Certification from DWQ. A copy of this application has been
provided directly to Chad Coburn in the DWQ Wilmington Office.
The project is located at the intersection of Hwy 211 and Midway Road, in the Midway Township, Brunswick
County (Latitude: 33.971944N; Longitude: -78.13085W). The project is located in the Lumber River basin and
onsite waters drain to River Swamp. The Water Quality Classification for River Swamp is C;Sw and the Stream
Index Number is: 15-25-1-6-1. The cataloging unit for the site is 03040207.
Project History
The proposed road improvements are a requirement by NCDOT to accommodate traffic generated by the Two
Eleven Midway Commercial Center, located in the northwest quadrant of the intersection of Hwy 211 and
Midway Road. NWPs 18 and 39 were issued to Midway/211, LLC on November 20, 2007 (AID #2005-833),
authorizing wetland and stream impacts associated with the Two Eleven Midway Commercial Center. The NWP
18 authorized 0.09 acres of wetland impact and NWP 39 authorized 0.18 acres of wetland impact and 438 if of
stream impacts to facilitate construction of the commercial center. Since the 438 if of stream impacts occurred to
an unimportant, intermittent stream, the 300 if threshold was waived. A copy of the NWP has been provided as
an Appendix to the PCN.
Since the issuance of NWPs in 2007, Midway/211, LLC has dissolved and is no longer a functioning entity.
MDI Management, Inc., owner of the property, took over management and construction of the Two Eleven
Midway Commercial Center in August 2008. All authorized wetland and stream impacts were completed and
Special Conditions were satisfied prior to MDI Management, Inc taking over the project.

Mr. Ronnie Smith with the Corps of Engineers issued a Preliminary Jurisdictional Determination for the
proposed improvement corridor on August 5, 2010. A copy of the Preliminary JD has been provided as an
Appendix to the PCN.
Proposed Impacts
The proposed impacts consist of 0.16 acres of permanent wetland impacts and 43 If of permanent stream
impacts. The proposed stream impacts will result from extension of the existing culverts for the widening of the
road. The proposed stream impacts consist of 16 if of permanent impacts to an unimportant, intermittent channel
(Impact A) and 27 if of permanent impacts to an important, perennial channel (Impact CI). The proposed stream
and wetland impacts will occur as a result of widening of Hwy 211 for the construction of additional turning
lanes and receiving lane for a double left hand turn lane on Midway Road. The proposed road improvements are
required by NCDOT to accommodate traffic generated by the construction of the 211-Midway Commercial
Center. Since the impacts from the road improvements are required to accommodate traffic from the commercial
center, the proposed road improvement impacts are considered cumulative impacts with the impacts from the
211 -Midway Commercial Center. Since the cumulative impacts from the 211-Midway Commercial Center and
proposed road improvements are less than 0.5 acres of wetland and less than 300 If of perennial streams
combined, the proposed road improvements meet the impact threshold for a NWP, and is eligible for
authorization under a NWP 14.

Avoidance and Minimization
Since the proposed project consists of the widening and improvements to an existing road, avoidance and
minimization of wetland and stream impacts could not be achieved.
During construction of the proposed project, silt fencing will be installed along all disturbed areas to prevent
sediment from escaping the project site.

Mitigation
The proposed 0.16 acres of permanent wetland impacts will occur within wetlands located within a regularly
maintained (mowed) NCDOT Right-of-Way. As a result of the frequent mowing, the functional value of the
wetlands is extremely low. Also, as a result of EEP only selling credits in 0.25 acre increments, the applicant
purchased 0.5 acres of wetland mitigation for the 0.27 acres of wetland impacts associated with the Two Eleven
Midway Commercial Center. Therefore, the applicant purchased an additional 0.23 acres of excess mitigation
beyond what was required by the Corps of Engineers. Due to the small size of the proposed wetland impacts
(0.16 acres), the low quality of the wetlands proposed for impact and the excess wetland mitigation purchased for
the Two Eleven Midway Commercial Center, mitigation is not proposed for the wetland impacts from the
proposed road improvements.
The applicant proposes a 1:1 mitigation ratio for the 43 if of proposed stream impacts. Therefore, the applicant
proposes to purchase 43 liner feet of stream mitigation from the Ecosystem Enhancement Program (EEP). A
copy of the Letter of Reservation from EEP has been provided as an Appendix to the PCN.
The current request is for 0.16 acres of permanent impacts to jurisdictional wetlands and 43 if of
permanent impacts to jurisdictional streams (see the attached maps and PCN for details).

Habitat?
W&R reviewed the NC OneMap Viewer GIS website, located at http://www.nconemap.net/Default.aspx?tabid=286, to
identify if any potential occurrence of endangered species on or near the proposed project. The review of the GIS
database identified several historic occurrences of endangered species within one mile of the project site. The database
identified that and occurrence of Red Cockaded Woodpeckers existed within one mile of the project site, but the accuracy
of the location was very low, and the species was last observed in 1979. The database also identified that Venus Flytrap,
Dissected Sneezeweed and Threadleaf Sundew have been observed within one mile of the project site, as recently as
2006. However, the proposed project consists of the widening of existing roads within an existing maintained NCDOT
Right of Way. There were no endangered species or potential habitat observed within the ROW. Therefore, it was
determined that the proposed project will not affect endangered species or designate habitat.

EFH waters within 2.0 miles of the project.

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicant's acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary_JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be"waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:

modified, reissued, or revoked prior to Marcll 18, 2012. It is incumbent upon you to remain informed of changes to the
NWPs. We will issue a public notice when the NWPs are reissued. Furthermore, if you continence or are under contract to
conwnence this activity before the date that the relevant nationwide pernnit is modified or revoked, you will have twelve (12)

SPECIAL CONDITIONS
1) In order to compensate for impacts to 0, lb acres of riparian wetlands the permitter shall make
payment to the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount
determined by the NC EEP, sufficient to perform the restoration of 0.16 acres of riparian
wetlands in the Limber River Basin, Cataloging Unit 03040207.
In order to compensate for impacts to 0.11 acres of non-riparian wetlands the pennittee shall
make payment to the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount
determined by the NC EEP, sufficient to perform the restoration of 0.11 acres of non-riparian
wetlands in the Lumber River Basin, Cataloging Unit 03040207.
Iii order to compensate for impacts to 438 linear feet of stream the permittee shall make payment
to the North Carolina Ecosystem Enhancement Program (NC EEP) in the amount determined by
the NC EEP, sufficient to perform the restoration of 219 linear feet of stream in the Lumber
River Basin, Cataloging Unit 03040207.
Construction within jurisdictional areas on the property shall begin only after the permittee has
made full payment to the NC EEP and provided a copy of the payment documentation to the
Corps, and the NC EEP has provided written confirmation to the Coifs that it agrees to accept
responsibility for the mitigation work required, in compliance with the MOU between the North
Carolina Department of Environment and Natural Resources and the United States Army Corps
of Engineers, Wilmington District, dated November 4, 1998.
1) The Permittee shall execute and cause to be recorded in the Brunswick County Register of Deeds
a Restrictive Covenant or similar mechanism (see attached Model) for the purpose of
maintaining 1.45 acres of wetlands and 1020 linear feet of stream adjacent to River Swamp in
their natural and/or mitigated state in perpetuity, within 30 days of this verificatioai or prior to the
sale or conveyance of any of this property, whichever occurs first. A final survey map of the
development, sealed by the licensed surveyor, which clearly depicts the surveyed areas of
Conservation, must also be recorded with the Brunswick County Register of Deeds at the same
time the Declaration is recorded.
These provisions relating to wetlands cannot be amended or modified without the express written
consent of the U.S. Army Corps of Engineers, Wilmington District." *This includes changes as
a result of any local government drainage easement requirements*

Dear Mr. Cooke:
You have our approval, in accordance with the attached conditions to impact 0.265 acres of 404 Wetlands and 438
linear feet of stream for construction of a commercial center as described in your application received by the N.C.
Division of Water Quality (DWQ) on February 26, 2009. After reviewing your application, it has been determined
that the impacts are covered by General Water Quality Certification Numbers 3699 (GC3699) & 3705 (GC3705).
This 401 WQC replaces the one issued on December 14, 2007 (version 1). These general certifications can be found
on line at: http://h2o.enr.state.nc.us/ncwetlands/rd wetlands certifications.him.
The Certification(s) allows you to use Nationwide Permits 12, 18 & 39 when issued by the US Army Corps of
Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state or
local permits before you go ahead with your project including (but not limited to) Erosion and Sediment Control,
Non-discharge, and stormwater regulations. Also, this approval to proceed with your proposed impacts or to
conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change your project, you
must notify us and you may be required to send us a new application. If the property is sold, the new owner must be
given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If
total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of stream,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This approval requires you to
follow the conditions listed in the attached certification and any additional conditions listed below.

2. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the CAMA Major application. All construction activities, including the
design, installation, operation, and maintenance of sediment and erosion control Best Management
Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur.
3. No Sediment & Erosion Control Measures wln Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they
shall be removed and the natural grade restored within six months of the date that the Division of Land
Resources has released the project.
4. Culvert Installation
Placement of culverts and other structures in waters, streams, and wetlands must be placed below the
elevation of the streambed by one (1) foot for all culverts with a diameter greater than 48 inches, and 20% of
the culvert diameter for culverts having a diameter less than 48 inches, to allow low flow passage of water
and aquatic life. Design and placement of culverts and other structures including temporary erosion control
measures shall not be conducted in a manner that may result in dis-equilibrium of wetlands or streambeds or
banks, adjacent to or upstream and down stream of the above structures. The applicant is required to provide
evidence that the equilibrium shall be maintained if requested in writing by DWQ. Culverts required for this
project shall be installed in such a manner that the original stream profiles are not altered. Existing stream
dimensions (including the cross section dimensions, pattern, and longitudinal profile) must be maintained
above and below locations of each culvert. Culverts shall be designed and installed to allow for aquatic life
movement as well as to prevent head cutting of the streams. If any of the existing pipes are or become
perched, the appropriate stream grade shall be re-established or, if the pipes installed in a perched manner, the
pipes shall be removed and re-installed correctly.
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant is required to return the attached Certificate of
Completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service
Center, Raleigh, NC, 27699-1650.
6. Construction Stormwater Permit NCG010000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of
Land Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES
General stormwater permit (NCG010000) administered by DWQ is automatically issued to the project. This
General Permit allows stormwater to be discharged during land disturbing construction activities as stipulated
by conditions in the permit. If your project is covered by this permit [applicable to construction
projects that disturb one (1) or more acres], full compliance with permit conditions including the
sedimentation control plan, self-monitoring, record keeping and reporting requirements are required.

7. Sewer Systems
The project shall comply with 15A NCAC 2I-I .0219(i)(2)(G) and all other State, Federal and local sewer
system regulations.

Violations of any condition herein set forth may result in revocation of this Certification and may result in criminal
and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to waters as
depicted in your application and as authorized by this Certification shall expire upon expiration of the 404 or CAMA
Permit.
If you do not accept any of the conditions of this Certification (associated with the approved wetland or stream
impacts), you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this
letter. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina General
Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved. You must also c0mR1Y with all other state, federal or local
government permits regulations or authorizations associated with the proyosed activity includingSL 2009-337: An Act to Promote
