REQUEST FOR MORE INFORMATION
Dear Mr.Worthington:
On August 12,2010,the Division of Water Quality(DWQ)received Public Notice from the U.S.Army
Corps of Engineers(issued on August 11,2010)to construct the proposed irrigation pond at the site. On
September 3,2010,the Division of Water Quality(DWQ)received the application fee and maps for the
above-referenced project, and on October 13,2010,the DWQ received the application for the above-
referenced project,to fill or otherwise impact 100 linear feet of perennial stream for construction of a 900-
foot x 100-foot earthen dam, excavate 3,670 linear feet of perennial stream to increase water storage
capacity of the lake, flood 2,107 linear feet of perennial stream, and 2,160 square feet of Zone 1 Neuse
River protected riparian buffers, and 1,440 square feet of Zone 2 Neuse River protected riparian buffers.
The project was last modified on December 17, 2007,and authorized impacts to 0.469 acres of 404/wetland
and 254 linear feet of perennial stream, 18,533 square feet of Zone 1 protected Neuse River basin riparian
buffers,and 19,912 square feet of Zone 2 protected Neuse River basin riparian buffers. The DWQ has
determined that your application was incomplete and/or provided inaccurate information as discussed
below. The DWQ will require additional information in order to process your application to impact
protected wetlands and/or streams on the subject property. Therefore,unless we receive five copies of the
additional information requested below, we will have to move toward denial of your application as required
by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review your project.
Additional Information Requested:
1. The DWQ was not able to locate a comprehensive alternatives analysis with alternative locations
identified or discussion of avoidance and minimization regarding proposed impacts to surface
waters. Please provide this information.
2. Please provide structural design drawings and details for the dam, including the plan and profile
views illustrating the height,toe, materials, and spillway.
3. Please submit a minimum water release plan for the proposed dam. The plan must include a
written explanation of the specific discharge rate and mechanism to provide for each required

release. The plan must also include any design specifications,details and calculations to show
that the release shall be achieved in the given conditions. The plan shall also include monitoring
that ensures compliance. The plan and any associated facilities, once approved,must be in place
and implemented upon the completion of the dam.
4. Please discuss your lake and dam maintenance plan and your emergency action plan if you have
one.
5. Please discuss how water quality standards will be maintained within the impoundment.
6. Please provide your stream mitigation plan.
7. Please locate your project boundaries on the most recent bound and published Pitt County soil
survey and the USGS 1:24,000 topographic map for the project.
8. Please locate the existing residential development referenced in your narrative on your full plan
sheets of the project and provide a proposed lot layout.
Please submit this information within 30 calendar days of the date of this letter. If we do not receive this
requested information within 30 calendar days of the date of this letter,your project will be withdrawn and
you will need to reapply with a new application and a new fee.
This letter only addresses the application review and does not authorize any impacts to wetlands,waters or
protected buffers. Please be aware that any impacts requested within your application are not authorized(at
