USACE Permit Action ID No. SAW-2007-02903-292, issued April 22, 2008; modification issued May 26, 2010. NCDWQ Major 401 WQC Project No. 20071470 ver. 1, issued March 17, 2008; ver. 2 issued May 5, 2010. The North Carolina Turnpike Authority (NCTA) is constructing a 12.6-mile long, new location roadway (Western Wake Freeway) in Wake County, North Carolina. The NCTA submitted an Individual Section 404 (of the Clean Water Act) Permit Application to the U.S. Army Corps of Engineers (USACE) for the subject project on August 27, 2007. On April 22, 2008, the Section 404 Permit was issued by the USACE (Action ID No. SAW- 2007-02903-292), and a modification was issued on May 26, 2010. The Section 401 Water Quality Certification (WQC) was issued by the North Carolina Division of Water Quality (NCDWQ) on March 17, 2008 (NCDWQ Project No. 2007-71470, ver. 1), and a modification was issued on May 5, 2010 (NCDWQ Project No. 2007-71470, ver. 2). Since issuance of the Section 404/401 Modification in May 2010, the NCTA has identified several permit areas that require additional impact. These additional impacts are described in this letter. Interchange Revisions at Old US 1 Since issuance of the permit modification, the NCTA has had to revise the proposed interchange at Western Wake Freeway/ Old US 1. This interchange is located in Section B and in Hydrologic Unit 03030002, which includes the Jordan Lake watershed. I NORTH CAROLINA TURNPIRE AUTHORITY TELEPHONE: 919-571-3000 FAX:. 919-571-3015 The loops on the Old US 1 Interchange require a 200 foot long tangent section of roadway within each loop for the Open Road Tolling Facility installation. The tolling equipment only works on a tangent section of road and will not properly toll traffic if the roadway is curving under the toll gantry. By adding the 200 foot long tangents to the loops, the loops become elongated, and consequently, the ramps need to be lengthened. When Ramp A was re-aligned and lengthened, additional impacts to Site 16 (stream) and Site 17 (wetland) in Section B occurred. Updated permit drawings and an updated permit summary sheet for these impacts are attached to this letter. Changes in the interchange result in: • Site 16 stream (permanent) impact increasing from 465 to 667 feet - an increase of 202 feet. The stream (temporary) impacts decreased from feet to 6 feet; and, • Site 17 wetland impact increasing from 0.05 acres to 0.11 acres - an increase of 6 - 0.06 acres. There are also new buffer impacts associated with Site 16. Permit drawings and a permit summary sheet for this buffer impact are attached to this letter. Based on the design, there are: • 13,410 square feet of impacts to Zone 1; and, • 8,651 square feet of impacts to Zone 2. Buffer mitigation will be required for these impacts which are located in the Lower New Hope Creek subwatershed. Additionally, a Jordan Lake Buffer authorization from the NCDWQ will be needed. Utility work at Beaver Creek During the July 2010 monthly agency construction review meeting, Raleigh-Durham Roadbuilders (RDR) discussed the need to convert an overhead utility to an underground utility. Based on the meeting and our discussion, impacts to wetlands have been avoided as a result of this change. A drawing depicting this work has been attached. As necessary and as noted on the drawing, the drill rig on the west side of the proposed Western Wake Freeway will operate on timber mats. Site 11 in Section C The May 2010 Permit Modification authorized the (permanent) impact to 349 feet of stream and the (temporary) impact to 88 feet of stream. ;Since issuance of the May 2010 Permit Modification, there were several large storm events on the project in late July 2010 and early August 2010. These large storm events caused the stream to de-stabilize upstream of the pipe inlet (right bank, looking downstream) in the NCTA right of way. 2 Per conversations with the USACE and NCDWQ during late July 2010 and early August 2010 about this site, the decision was made to lay the banks back and place coir fiber matting on the banks. All agreed to review the area at the monthly agency meeting on August 23, 2010. At the monthly agency meeting on August 23, 2010, it was decided that rip rap should be placed on the banks to stabilize them in order to provide long term stability of the stream reach. The overall proposed action at this site will result in the (permanent) impact to 387 feet of stream and the (temporary) impact to 55 feet of stream. By placing the r?i?rap, there would be an additional (permanent) impact to 38 feet of stream and a decrease o eet L_(-te_mporary) impact of stream. Site 29 in Section C The construction of a water line downstream of the pipe crossing at the proposed Western Wake Freeway /US 64 interchange was not addressed in the permit modification from May 2010. The May 2010 Permit Modification allowed for (permanent) impact to 216 feet of stream and the (temporary) impact to 11 feet of stream, but these impacts did not include construction of the water line. The work at this site was discussed at the August 23, 2010 monthly agency meeting, and it was decided that a temporary stream impact would be necessary. The total (permanent) impacts at the site are now 216 feet of stream and (temporary) impact to 59 feet of stream. With the inclusion of the water line, there is now an additional (temporary) impact to 48 feet of stream for the site. 21g 29 'in Section C is in the Jordan Lake watershed. The construction of the water line at this site results in a buffer disturbance greater than 40 feet; therefore, a Jordan Lake buffer authorization is required. Impacts to the buffer are: I . 3,107 square feet of impacts to Zone 1; and, I • 2,319 square feet of impacts to Zone 2. r This impact is allowable without mitigation. Site 31 in Section C This site impact was permitted in the May 2010 modification. Per a phone conversation between Mr. Eric Alsmeyer of the USACE and Mr. Phillip Todd of SEPI Engineering & Construction (SEPI) on September 10, 2010, a new plan view sheet has been provided to update the proposed work at the site. There are no additional impacts as a result of this update. Summary These additional impacts to wetlands, streams and buffer with the Western Wake Freeway project are unavoidable. To compensate for these impacts, the NC Ecosystem Enhancement Program has agreed to provide compensatory mitigation. Their acceptance letter is attached. 3 REGULATORY APPROVALS We ask that you modify the existing project Section 404/401 Individual Permit to reflect the additional jurisdictional impacts associated with the changes noted in this letter. We asked that the NCDWQ issue a Jordan Lake buffer authorization for impacts at Site 16 in Section B and Site 29 in Section C. The EEP acceptance letter is attached. The NCDOT (TA) will be responsible to ensure that appropriate compensation for the buffer mitigation will be provided in the agreed upon method of fund transfer. Upon receipt of the NCDWQ's Buffer Authorization Certification, EEP will transfer funds from MOA Fund into the Riparian Restoration Buffer Fund. Upon completion of transfer payment, NCDOT will have completed its riparian buffer mitigation responsibility for R-2635. EEP commits to implementing sufficient buffer mitigation and the additional stream and riparian wetland mitigation credits to offset the additional impacts associated with this project in accordance with the N.C. Department of Environment and Natural Resources' Ecosystem Enhancement Program In-Lieu Fee Instrument dated July 28, 2010. If the above referenced impact amounts are revised, then this mitigation acceptance letter will no longer be valid and a new mitigation acceptance letter will be required from EEP.
