Thank you for meeting with Kimley-Horn and Martin Marietta and for the opportunity to
discuss with you the permitting issues that remain to be resolved related to mine
expansion. The attached material is being submitted as Martin Marietta Material's
response for additional information and as response to questions and issues that have
arisen during the various meetings and conversations related to the project. In addition,
the following summary of the meeting on March 28, 2007 is provide for your
information.
The meeting on March 28, 2007 was conducted at the Offices of the Corps of Engineers
and was attended by Mr. Ian McMillan and Ms. Cynthia Van Der Wiele, Mr. Monte
Matthews, Mr. Steve Whitt of Martin Marietta, Mr. Ryan Lewis, and Harlan Britt of
Kimley. Several issues were discussed with the following consensus being reached.
1. The Division of Water Quality determined on January 25, 2007 that the stream
reach across the subject property, except that length of stream contained in the
existing pipe under the earth berm, down to the confluence with Boyd's Creek is
classified as perennial. The stream measures 1230 feet of open channel from the
northern boundary down to the Importance call, 887 feet to the proposed pit
boundary and 829 feet to the southern property boundary for a total stream
distance of 2,946 feet. Martin Marietta understands for impacts to this stream

reach the state will require mitigation and that the state will require a minimum of
1:1 ratio for that mitigation.
2. The Corps of Engineers has determined that the stream from the northern property
boundary to a point identified in the field and as indicated in the permit
application which is below the existing road crossing of the relevant stream is
considered to be Unimportant and from that established point to the proposed
southern pit boundary the stream is considered Important for a total distance of
887 feet. This 887 feet of Important stream is included within the perennial stream
call of the DWQ and therefore the Corps of Engineers will accept the State's
mitigation requirement for the stream impacts from the northern property
boundary to the proposed southern pit expansion limits. From proposed southern
pit boundary down to the confluence with Boyd's Creek, a distance of 829 feet,
the Corps of Engineers will require mitigation for impacts of this stream reach at a
2:1 ratio.
Given the lengths of impact indicated in paragraph 2 above plus the 98 feet for the
culvert road crossing and the stated mitigation ratios, the total length of impacts
for the project is 3044 feet with a required mitigation of 3,971 feet.
Martin Marietta proposes to mitigate for the stream impacts by payment to the NC
Ecosystem Enhancement Program which is the preferred alternative to the NC
Division of Water Quality.
The issue related to the redirection of the pond discharge around the future pit was
discussed. It was explained that the BMP located at the outlet of the discharge
was solely for the purpose of diffused flow from the outlet and to extend the
hydration period resulting from the pond discharges. There will be no increased
impervious areas contributing to this discharge and therefore, stormwater
management is not an issue. It was agreed that the discharge facility was not
required and that this proposed facility was not considered as a stormwater BMP
and did not require DWQ approval.
It is our understanding that a new public notice will be issued by the Corps of Engineers
and that a copy of that notice will be provided directly to the DWQ for their records. A
public meeting announcement will be a part of the public notice and Martin Marietta will
participate in the meeting. It is proposed that the public meeting be held at the Faucette
Volunteer Fire Department located at 3847 N. NC 49 north of Haw River, NC.

We believe the conclusions of our meeting is incorporated in the above and we will be
modifying the Individual Permit application and will submit the same to you along with
comments addressing the issues raised in your letter to Martin Marietta Materials of
January 31, 2007. We look forward to the completion of the Individual Permit process
