Dear Mr. Tharrington,
I am in receipt of the above referenced NOV dated September 30, 2020 and wanted to apologize in
advance for not responding sooner. As you are aware, Old North State Water terminated its
relationship with Envirolink, Inc. for contract operations the last week in September 2020. As you could
imagine, we had a lot on our plate fixing the deferred maintenance left behind from Envirolink. During
this transition, I was making contact with many people with in NCDEQ to make introductions and
notifying them of the Envirolink change. One of the many reasons we terminated Envirolink is regarding
NOV's. It was brought to our attention from NCDEQ that Old North State had outstanding violation
penalties that were unpaid. Since Envirolink (Mike Myers) was listed as the owner, all the NOV's were
going to his address in NC and we were never notified in our Birmingham, Alabama office. To make
things worse Mike Myers never told us about any violations or paid for many violations. On October 2,
2020, 1 had a phone conversation with Dean Hankele as I was trying to get the contact names and
addresses changes within your data base so we would receive notification and not Envirolink for such
things as NOV's. In that October 2n0 conversation, Dean told me that Envirolink (Mike Myers) had not
responded to the above referenced NOV. Being as it may, this was the first NOV we had received in the
office and since it was from July 2020 and something Mike Myers should have responded to, we did not
think we needed to anything. It was not until a few weeks ago that our owner John McDonald was on a
conference call with your Wilmington group that Dean had brought up this NOV. Again, I apologize for
the misunderstanding and not responding.
In regards to the reference NOV, we have installed all new HOMA Vortex pump in each lift station in
Majestic Oaks (see attached). Unbeknownst to us, Envirolink was operating Majestic Oaks lift stations
with only one pump. Somewhere along the way, pumps failed in the lift stations and they did not make
the repairs. It was not until we receive this NOV on October 2"° that we investigated this violation and
that is when we found that the lift stations only had one working pump. As you know, with a lift station
only having one working pump and that pump fails it can create a major issue. It is our assumption that
is what occurred on 7/16/20 at the Mae Drive pump station. After receiving this NOV, we made the
immediate decision to install new pumps so each lift station has two working pumps. We continue to
work with our operator at Majestic Oaks to provide him the support needed to operate Majestic Oaks.
Please reconsider the enforcement of the civil penalty, as we are working diligently to solve the issues.
We are under contract to sell the Majestic Oaks WWTP but are waiting on the Utilities Commission, as
they must approve a utility acquisition and transfer. We have filed our seller Docket number W-1300-
Sub 69 with the Utilities Commission and purchaser has filed their purchaser docket number W-1305-
Sub 29 all of which is public record. In a perfect world, we are hoping this is approved and sold by the
end of February.
