application:
The subject site is mostly forested with a Colonial Pipeline utility easement running through the northeast corner of the
property. The surrounding land use is primarily residential, with new residential subdivisions currently being constructed.

The purpose of the proposed project is to construct the Salem Village subdivision, including the section of Apex Peakway
from Tingen Road to Salem Street, to provide additional residential housing for the area. The proposed impacts to
streams and wetlands are necessary to construct the necessary development roadway infrastructure as well as for the
required utility installations.

The proposed development will be for a residential subdivision with typical roads and utilities and section of major
thoroughfare road. Heavy equipment typically necessary for road and home construction, as well as utility
installation, will be used.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant requested a detailed delineation of streams and wetlands prior to site plan development in order to
determine the extent and location of streams and wetlands on the subject property. The site plan has limited permanent
impacts to three road crossings within wetland areas. There is one proposed stream crossing of an
unimportant/intermittent channel, however the applicant has opted to utilize a spanning structure so as to avoid
permanent channel impacts. Streams are not crossed multiple times by roads. The proposed road crossings are
necessary in order to provide the needed internal roadway infrastructure connectivity required for resident and emergency
vehicle access.
The applicant is also aware of the regional conditions associated with the Nationwide Permit 29. With respect to
residential development conditions (Regional Conditions section 4.9) the applicant does not anticipate any impacts to
streams or wetlands associated with any required stormwater facilities, there are no proposed single-family recreation
facilities, there are no 100 year floodplain limits identified on this project and therefore, there are no permanent wetland or
stream fills proposed within the floodway and finally, the stream classification for this project is C (i.e. not Outstanding
Resource Waters or High Quality Waters).
The applicant recognizes that the proposed temporary impacts for the sewer line installation will be for the minimum
period of time required to complete the activity and that the stream and wetland areas must be returned to pre-impact
conditions. The proposed sewer line construction corridor as well as the proposed permanent easement corridor is only
20 feet wide (i.e. does not exceed 40 feet in width). The proposed sewer line is not anticipated to interfere with navigation
nor is it proposed to be aerial in nature. No rip-rap is proposed for the stream crossing for the proposed sewer line
installation.
Apex Peakway - The applicant requested a detailed delineation of streams and wetlands of the proposed Apex Peakway
corridor in order to determine the extent and location of streams and wetlands within the area. The proposed roadway
corridor has limited permanent impacts to three road crossings, 2 of which are stream crossings and one crossing which
is within a wetland area. For the two proposed stream crossings, the applicant has opted to utilize bridges so as to avoid
channel impacts. Streams are not crossed multiple times by the proposed roadway. The proposed road crossings are
necessary in order to connect the existing termini of the Apex Peakway at South Salem Street (the northern boundary)
and Tingen Road (the southern boundary). The purpose of the proposed Apex Peakway is to build a four-lane
divided roadway that will service the proposed and existing residential developments in the area, as well as
providing an alternate north-south connector between NC 55 and US 1 in Apex. Road shoulders were made as
steep as possible at the wetland crossing locations (2:1) to minimize impacts.

Orange protective fencing will be placed outside of the impacted wetland corridor to ensure protection of the non-
impacted wetlands. It is the intent of this plan for construction impact to take place during the dryer months of the year.
Also where the sewer line installation occurs within wetland areas, as each section of sewer main is installed the ground
elevations will be restored and seeded with wetland type grasses immediately. The sewer alignment was determined in
the field to minimize the impacts to trees and wetlands while allowing more efficient installation techniques to minimize
negative impacts.

We have reviewed the "DRAFT Internal Policy, Cumulative impacts and the 401 Water Quality Certification and Isolated
Wetland Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version 2.1. The draft states that
most residential subdivisions and small scale commercial developments are unlikely to cause cumulative impacts. This project
does not meet any of the three criteria of private projects that can clearly result in cumulative impacts. This development is
relatively small in nature, is within a residentially developed landscape bounded by South Salem Street and US 1 to the north
and south respectively and therefore, the utility infrastructure (i.e. water and electricity) are already in place to service the
proposed development. We anticipate that you will advise us if a qualitative or quantitative impact analysis is required.
Apex Peakway - While the proposed Apex Peakway is a "road on a new location" which has the potential for growth-stimulating
effects, the surrounding area has been built upon or is currently being built upon. It is this "build-out" that has necessitated the
construction of this road. Additionally, the proposed Apex Peakway is within the Town of Apex's Extraterritorial Jurisdiction Area
(ETJ) and as such is subject to the Unified Development Ordinance which has provisions within to prevent the degradation of
downstream water quality due to development. We anticipate that you will advise us if a qualitative or quantitative impact
analysis is required. This application only proposes to connect two existing sections of the Peakway from Tingen Road and
Salem Street.
4. Sewage Disposal (DWQ Requirement)
4a. Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from
the proposed project, or available capacity of the subject facility.
This project will connect to existing sewer lines. The Town of Apex will insure that the capacity of their treatment facility

The NC-Natural Heritage Programs Virtual Workroom was used to search for elemental occurrences of state and
federally protected species in the vicinity of the project. It was determined based on the search that elemental
occurrences of one state species of concern exist within 2 miles of the center of the project area. There were no
elemental occurrences of federally threatened or endangered species within 2 miles of the center of the project area.

The purpose of this letter is to notify you that the North Carolina Ecosystem Enhancement Program (NCEEP) is willing to accept
payment for impacts associated with the above referenced project. Please note that this decision does not assure that the payment will
be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact these
agencies to determine if payment to the NCEEP will be approved. You must also comply with all other state, federal or local
government permits, regulations or authorizations associated with the proposed activity including SL 2009-337: An Act to Promote
Compensatory Mitigation by Private Mitigation Banks.
This acceptance is valid for nine months from the date of this letter and is not transferable. If we have not received a copy of the
issued 404 Permit/401 Certification/CAMA permit within this time frame, this acceptance will expire. It is the applicant's
responsibility to send copies of the permits to NCEEP. Once NCEEP receives a copy of the permit(s) an invoice will be issued based
on the required mitigation in that permit and payment must be made prior to conducting the authorized work. The amount of the In
Lieu Fee to be paid to NCEEP by an applicant is calculated based upon the Fee Schedule and policies listed at www.nceep.net.
Based on the information supplied by you the impacts that may require compensatory mitigation are summarized in the following
