Dear Mr. Eapen:
Our files indicate that the subject permit issued on
December 4, 1992 expires on December 4, 1993. We have not
received a request for renewal from you as of this date as
required by the subject permit. A renewal request shall consist
of a letter requesting renewal and completion of an application.
A processing fee of $400 must be submitted with the request.
The Environmental Management Commission adopted revised
rules on October 1, 1990 requiring the payment of an annual fee
for most permitted facilities. You will be billed separately for
that fee, if applicable, after your permit is approved.
Please be advised that this permit must not be allowed to
expire. If the renewal request is not received within 180 days
prior to the permit's expiration date as required by 15A NCAC 2H
.0211, you will be assessed an automatic civil penalty. This
civil penalty as allowed by North Carolina general statute may be
as much as $10,000 per day. If a permit renewal request is not
received 180 before permit expiration, a civil penalty of at
least $250 will be assessed. Larger penalties may be assessed
depending on how late the request is made. In addition, any
permit renewal request received after the permit's expiration
date will be considered as a new application and will be required
to pay the higher permit application fee.

No. 61, and below)
ANALYTICAL REQUIREMENTS:
(a) If the source of the soil contamination is a virgin (unused) petroleum product from an
underground storage tank regulated under Subtitle I of RCRA, no TCLP analysis is required. If you
are unsure if this exemption applies to your situation, see Note #3 at end of this attachment.
(b) IF AN ANALYSIS OF THE SOURCE PETROLEUM PRODUCT IS SUBMITTED, SHOWING NO
CONCENTRATIONS HIGHER THAN THE REGULATORY LEVEL ASSOCIATED WITH THE CONTAMINANTS
LISTED IN TABLE I (see last page of this Attachment), SOIL IS AUTOMATICALLY NON -HAZARDOUS
AND NO TCLP ANALYSIS IS REQUIRED AND NO DOCUMENTATION, AS SPECIFIED IN THE NOTE #1:
BELOW, IS REQUIRED;
(c) For soils contaminated with used motor oil, a TCLP analysis of the metals 2nhC
(EPA Hazardous Waste Nos. D004-Dai1 - see Table 1), is required.
(d) For soils contaminated by 'waste oil' (i.e. used petroleum products other than, or in addition to,
crankcase oil); a TCLP analysis of both volatile and metals is required.
(e) For soils contaminated with other petroleum products not regulated under Subtitle I, (excluding

Land Application
of oil Contaminated Soil
Dear Mr. Bograd:
Attached are three copies of the revised plan for minimum rate land
application and erosion control of petroleum contaminated soil.
Please note that the revision includes spreading the soil to one
inch thickness and incorporating into the upper 6 to 8 inches of
native soil. To achieve this we have changed the location of the
application area. You inspected this area during your recent visit
to the plant.
We have forwarded the revision to the Gaston County code
enforcement and will send you the approval as soon as we receive it
from them.
We apologize for any inconvenience this revision may have caused.

SUBJECT: Project Denial - American & Efird 1A1-EE.3GH% , N,C;
A complete application to land apply petroleum contaminated
soils was received on October 23, 1992. After review of the
application on November 9, 1992 and a site visit on November 10,
1992, I determined that it would be impossible to incorporate the
contaminated soil into the top six to eight inches of native soil
at the proposed site. The inability to incorporate the soil is
due to the presence of a considerable amount of pine trees on the
proposed site. The roots of the pine trees are extensive and
close to the surface; thereby, preventing the incorporation of
the petroleum contaminated soil.
Please find attached a denial letter, with diskette, drafted
for Mr. Preston's signature and a copy of the application to land
apply soils.

This letter is in reference to the request for a
Winston-Salem soils landfarming permit for petroleum -contaminated
919/896-7007 soils received on October 23, 1992.
Your application must be denied since the subject'
site does not meet the minimum design requirements for
land application of petroleum -contaminated soils. The
site is unsuitable due to the presence of pine tree
roots that will prevent the incorporation of
contaminated soil into the top six to eight inches of
the native soil.
If this denial is unacceptable to you, you have
the right to request an adjudicatory hearing upon
written request within thirty (30) days following
receipt of this denial. This request must be in the
form of a written petition, conforming to Chapter 150B
of the North Carolina General Statutes, and filed with
the Office of Administrative Hearings, Post Office
Drawer 27447, Raleigh, North Carolina 27611-7447.
Unless such demands are made, this denial shall be
final and binding.

MINIMUM RATE SOILS LAND APPLICATION PERMIT

In accordance with the provisions of Article 21 of Chapter
143, General Statutes of North Carolina as amended, and
other applicable Laws, Rules, and Regulations
PERMIT No. SR 0300069 IS HEREBY GRANTED TO
AMERICAN & EFIRD
GASTON COUNTY
FOR THE
disposal and treatment of approximately 250 cubic yards of soil
containing fuel oil #5 and fuel oil #6 from American & Efird
Plant #15, located at 22 American Street in Gaston County onto a
1.86 acre disposal area located at 22 American Street in Gaston
County, with no discharge of wastes to the surface waters. This
permit is issued pursuant to the application received on November
30, 1992, and in conformity with the project plan,
specifications, and other supporting data filed and approved by
the Department of Environment, Health and Natural Resources and
considered a part of this permit.
This permit shall be effective from the date of issuance
until December 4, 1993, and shall be subject to the following
specified conditions and limitations:
I. PERFORMANCE STANDARDS
1. The Mooresville Regional Office, telephone number
(704) 663-1699, shall be notified at least forty-
eight (48) hours before land application of the
contaminated soils. To allow for a site
inspection, application shall be initiated, and
the Regional Supervisor shall be notified, during
the normal working hours of 8:00 a.m. until 5:00
p.m. Monday through Friday, excluding State
holidays (unless another time has been arranged
with.the Regional Supervisor).

2. In the event that the facilities fail to perform
satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate
corrective action, including those as may be
required by the Division of Environmental
Management (hereinafter Division),, such as the
operation of additional or replacement treatment
or disposal facilities.
3. The issuance of this permit shall not relieve the
Permittee of the responsibility for damages to
surface waters or groundwaters resulting from the
operation of this facility.
4. The following minimum buffers shall be maintained:
a) 100 feet between disposal area and any public
or private water supply, including wells.
b) 100 feet between disposal area and "SA and
SB" classified surface waters.
c) 50 feet between disposal area and any
stream, lake, river or natural drainageway.
d) 50 feet.between disposal area and property
lines.
e) 10 feet between disposal area and surface
water interceptor drains or diversions.

f) 25 feet between disposal area and surface
water interceptor drains or diversions
(downslope) and groundwater drainage systems.
g) 100 feet from any habitable residence or
place of public assembly under separate
ownership.
5. No food for direct human consumption shall be
grown on the land application site for at least 6
months following the Division -approved completion
of contaminated -soil disposal.
6. No soils contaminated with heavy fuel oils (#4, #5
or #6),or new.or used motor oils, shall be applied
to sites where food -chain crops are growing, or
will be grown during the terms of the permit.
7. No soils containing petroleum products, other than
as specified in the permit application,'shall be
_ placed on the land application site without
permission from the Mooresville Regional
Supervisor.

II. OPERATION AND MAINTENANCE REQUIREMENTS
1. Adequate measures shall be taken to prevent
surface runoff from carrying any disposed material
into any surface waters.
2. The 250 cubic yards of contaminated soil shall be
spread to a thickness not to exceed one (1) inch
on at least 1.86 acres of land at the disposal
site.
3. The contaminated soil shall be thoroughly
incorporated into the top six to eight inches of
the native soils, by tilling or disking, within 24
hours of the initial spreading of the contaminated
soils onto the site.
4. A suitable vegetative cover shall be established
and maintained on all sites.
5. All foreign debris shall be removed from the
contaminated soils prior to land applications, and
at no time shall foreign debris be land _applied to
the approved site during the life of this permit.
III. NONCOMPLIANCE REPORTING REQUIREMENTS
The Permittee shall report by telephone to the
Mooresville Regional Office, (704) 663-1699, as soon as
possible, but in no case more than 2.4 hours or on the
next working day following the occurrence, or first
knowledge of the occurrence, of any of the following:
a) the land application or otherwise disposal of
significant amounts of wastes which are not
in accordance with the terms and conditions
of this permit.
b) any failure of the land application program
resulting in a discharge of wastes'to the
groundwaters or surface waters of the State
in contravention of applicable assigned
quality standards.
c) any spillage or discharge from a vehicle or
piping system transporting contaminated soil
to the application site.

insure compliance with applicable state, federal
or local laws and regulations.
2. Any duly authorized officer, employee, or
representative of the Division of Environmental
Management may, upon presentation of credentials,
enter and inspect any property, premises or place
on or related to the disposal site and facility at
any reasonable time for the purpose of determining
compliance with this permit; may inspect or copy
any records that must be kept under the terms, and
conditions of this permit; or may obtain samples
of groundwater, surface water, or leachate.
V. GENERAL CONDITIONS
1. This permit is effective only with respect to the
nature and volume of wastes described in the
application and other supporting information.
2. This permit is not transferable.
3. Failure to abide by the conditions and limitations
contained in this permit may subject the Permittee
to an enforcement action by the Division of
Environmental Management in accordance with North
.Carolina General Statutes 143-215.6A,-215.6B and
-215.6C.
4. The issuance of this permit does not preclude the
Permittee from complying with any and all
statutes, rules, regulations, or ordinances which
may be imposed by other government agencies
(local, state, or federal) which have
jurisdiction.

Dear Mr. Eapen:
I have completed the review of the Erosion Control Plan for the
above referenced project.. The Erosion Control Plan is in
compliance with the current Gaston County regulations and is
approved with the following stipulations:.
1. The Gaston County Code Enforcement Inspector must make an
inspection of the site before a building permit can be
issued. The County reserves the right to inspect the site at
all reasonable times.
2. Failure to conduct land -disturbing activities, except in
accordance with the provisions of the approved plan, shall be
deemed in violation of the Gaston County Soil Erosion and
Sedimentation Control Ordinance.
3. All Erosion and Sedimentation Control measures and/or devices
shall be maintained during development of the site.
4. Whenever the Code Enforcement department determines that
significant off -site sedimentation is occurring as a result of
land disturbing activities, despite application and
maintenance of protective practices, additional protective
measures will be required.
5. Swales and diversions are to be used to divert flow
and sediment into sediment basins where the
existing elevations prohibit natural concentration
of flow directly into the basins.

6. Pre -construction conference required prior to any grading
activity with engineer, developer, grading contractor and
Gaston County Code Enforcement.

application. Approximately 250 c. yds. of oil contaminated soil
will be applied over 2 acres of land behind Plant 15 in Mt. Holly.
This soil is from an underground fuel oil (#5 & #6) storage tank -
(3) re,noval project. We intend to apply the soil at minimum rates.
The thickness of the soil when applied will be limited to one inch.
