The facility continues to manage their residuals in the on -site storage lagoons. Data records were found to be in excellent order. Please note the issues below to maintain overall compliance: • Per conversation, Rip -Rap placed for berm stabilization was verified as free from contaminants. The documentation was requested to be emailed to: Maria.Schutte(a),ncdenr.jEov. • Lagoon storage requires two feet of freeboard be maintained. The appropriate water level gauges, with inch or tenths of afoot increments, need to be placed at the lowest point of each lagoon berm. Noted in the staffport that afield has been lost to chicken houses and family is likely to utilize chicken litter on ad'acent f elds. Ticona has not land applied in a few years, but currently plans to in Spring of 2014. EMA Resources is the current land application contractor. Land Application records are filed on -site and were well organized. Both the WWTP and records appeared to be maintained in accordance with permit conditions. The current permit is due to expire on April 30tr', 2015. Celanese is the parent company of Ticona, and per discussion with Pem Carter, they plan a name change to Celanese. Nelson, l Chief/f Groundwater Section v� SUBJECT: Hoechst Celanese Landfill I have discussed subject site with Jesse and advised him to monitor Hoechst Celanese progress in the implementation of their corrective action plan. As we have issued an NOV for groundwater standards violations, the company is proceeding toward remediation in a responsible manner, and the site is relatively low on your priority list, I see no need for heavy involvement by your staff. I am unable, at this time, to provide you with clear guidance on our responsibility with regard to sites in which the Solid Waste Management Division is involved. The following paragraphs generally describe my views on how we ought to handle situations involving SWMD. I would appreciate your views and Brenda's as well. Where Solid Waste Management Division is clearly the lead agency for enforcement of environmental rules, and finds themselves unable to discharge their regulatory responsibility, and groundwater violations have occurred, then the Division of Environmental Management should provide the environmental "safety net" and implement its regulatory authority as appropriate. To be more specific, where a facility has caused groundwater contamination and that facility is, or would normally be, under the regulatory authority of the Solid Waste Managaement Division (hazardous waste, solid waste or Superfund) and the SWMD is unable to accept or continue its lead agency role, we the Groundwater Section, must step into the breach and use our own authority to. protect or cleanup the groundwaters. We should issue an NOV, if we have not already issued one, and require cleanup under the terms of an SOC (until such time as SOC' s are no longer required). Barbara Christian Page Two September 4, 1991 Conversely, where we discover, or are the first responder to an incident involving a facility clearly identified as the source of groundwater contamination, and the contamination is as a result of the release or disposal of hazardous wastes, we should inform the SWMD immediately, in -writing, of our intention to advise the responsible party of the violation and the pertinent regulatory requirements under the DEM rules, and our intention to defer to the SWMD as the lead regulatory agency but retain the right of enforcement should the facility fail to act in accordance with SWMD's requirements, or should other circumstances develop which made enforcement action by DEM necessary. For facilities which are on the State Superfund Section's inactive site list, I believe we should exercise any authority we have to implement cleanup of any such site we find to be a significant problem.
