DANIEL SMITH Director Mr. Byron Melvin 4912 NC Hwy. 87 W Elizabethtown, NC 28337 NORTH CAROLINA Environmental Quality December 16, 2020 Subject: Notice of Deficiency Melvin Bros Farms LLC NCA209044 Bladen County NOD-2020-PC-0475 Dear Mr. Melvin: On September 29, 2020, staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section (WQROS) inspected the Melvin Bros. Farms LLC waste disposal system. We wish to think Mr. Melvin, who was present and assisted during the inspection. As a result of this incident, you are hereby notified that, having been permitted to have a non - discharge permit for the subject animal waste disposal system pursuant to North Carolina General Statutes G.S. 143-215 et seq. Section .402, you have been found to have been found to be in violation of your permit as follows: Deficiency 1: Failure to test and calibrate all waste application equipment at least once per year. The results must be documented on forms provided by, or approved by, he Division [15A NCAC 02T .1305(b)] NCA200000 Section IV 12. On September 29, 2020 during your routine compliance inspection, it was documented that you failed to calibrate your waste application equipment during 2019. The last documented calibrations were done in 2018. You have other permitted swine farms that operate under the State General Permit AWG100000. If you use any waste application equipment from these farms it must also be calibrated every year. You are required to take any necessary action to address the above violation: The Division of Water Quality requests that, in addition to the specified corrective action above, please submit the following items on or before January 16, 2021. 1. An explanation from the OX for this farm regarding how this violation occurred. 2. A list from the O1C concerning the steps that will betaken to prevent these violations from occurring in the future. 3. Documentation that the waste application equipment has been calibrated for 2020. Failure to comply with conditions in the permit may result in a recommendation of enforcement action, to the Director of the Division of Water Resources who may issue a civil penalty assessment of not more than twenty-five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A If you have any questions concerning this Notice, please contact Steve Guyton at (910) 303-0151 or at Steve. uyion o,ncdenr.gov.
