Sullins Dee Freeman Governor Director Secretary October 12, 2010 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Tom Walker, Field Chief U.S. Army Corps of Engineers Wilmington Regulatory Field Office 69 Darlington Wilmington, NC 28403 Subject Property: Dear Mr. Walker: Carolina Marina DWQ Project # 06-0137, Ver. 2 New Hanover County On behalf of the NC DWQ 410/Wetlands Permitting Unit, we respectfully request that you consider the following comments within your review of the 404 Individual Permit request for the above referenced property: 1. If the applicant configures the site to resolve the concerns of the Division of Marina Fisheries concerning the existing water depths and potential adverse impacts to the Primary Nursery Area, then the DWQ does not have an issue with this project. 2. We would recommend that should this project be permitted under Section 404, that a condition be included prohibiting dredging within the PNA. Thank you for your attention. If you have any questions, please contact Amy Chapman or me in our Central Office in Raleigh at (919) 733-1786.
