On June 10, 2010, the Division of Water Quality (DWQ) received your revised Bank Parcel
Development Plan (BPDP), dated June 2010) for the EBX Rudolph Site in Johnston County, North
Carolina. The DWQ approves the site for addition into the EBX Neuse Riparian Buffer Umbrella
Mitigation Bank. The BPDP proposes to generate 3.5 acres (150,865 ft) of riparian buffer credit and
38.8 acres (88,192 lb-N) of nitrogen offset credit. On September 20, 2010, DWQ received the
Conservation Declaration dated September 16, 2010 and on July 21, 2010 received the Performance
Bond executed July 19, 2010.
The Umbrella Mitigation Banking Instrument was approved through execution of the UMBI by the
Director on October 20, 2008.
According to the UMBI, the following Project Milestones have been met, and the corresponding credits
shall be released:

and financial assurances provided 20%
By copy of this correspondence, DWQ confirms that you have satisfied the above requirements for the
above-referenced tract and 20% of your nutrient offset credits (0.2 x 88,192 =17,638.4 lb-N) are now
available for sale. Also, 20% of your riparian buffer credits (0.2 x 150,865 = 30,173 ft2 credits) are
now available for sale.
When the mitigation site earthwork and planting and installation of monitoring devices is complete,
DWQ will release an additional 20% of the credits resulting from the successful completion of Task 2 of
your credit release schedule.
