I I' Dear Dc Thorpe: Dee Freeman Secrelary The NC Division of Water QualiTy has reviewed your submittal for a 401 Water Quality Certification and Tar-Pamlico Buffer Authorization for the aforementioned project. Review of your application revealed it lacking necessary infortnation required for making an infortned permit decisioa The permit application was deficient in the following areas: Buffer impacts Iisted incorrectly. The buffer impact summary sheet included with the modification request lists the buffer impacts associated with the bridges at Sites lA and 4C as mitigable. According to 15A NCAC 2B .0259(6), buffer impacts due to the bridge structures are allowable and do not require mitigarion. The road approaches leading to the bridge are considered road crossings and would trigger mitigation if buffer impacts exceed 150 tinear feet or one-third of an acre. Please modify your buffer impact calculations to reflect this. ' Stream classification. Please identify the jurisdictional streams in the project azea as intermittent or perennial. This is necessary for mitigation purposes. Also, a recent field visit to the project area by DOT and DWQ staff on June 15, 2010 revealed that the stream at Site 2 may not be jurisdictional. Please confirm this with the Army Corps of Engineers and adjust stream impact calculations as needed. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the pertnit application on hold until we are supplied the necessary informatioa You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing,.we will assume you are withdrawing ? your application and it wifl be returned. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers place the permit application on hold. c9 .
