We are requesting to place culverts and headwalls in 1 stream and 1 subterranean sewer line in another stream for the purpose of constructing Panther Rock Subdivision Phase I. The proposed road crossing location will also include a sewer line. A third aerial sewer crossing is also proposed. 61 homesites are proposed for this subdivision. These proposed impacts are contained in the attached packet of information. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please show all stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. 2. Please show all wetland impacts including fill slopes on the site plan. Please indicate proposed lot layout as overlays on the site plan at a scale of no smaller than 1"=50' Also, show wetlands and streams on the same plan so we can determine if additional impacts are likely. 4. Please clearly indicate all Zone 1 and Zone 2 buffers, and impacts to these, on the site plan. 5. Please provide diffuse flow provision measures, applicable worksheets and a signed and notarized Operations and Maintenance agreement for the site. 6. The proposed Neuse River basin riparian buffer (NRBRB) impacts are subject to 15A NCAC 02B .0233. Impacts associated with this project include 143 linear feet of perennial stream, 7,750 square feet of Zone 1, and 5,000 square feet of Zone 2 NRBRB areas. Please find attached supplemental information requesting written concurrence from the United States Army Corps of Engineers (COE) and the North Carolina Division of Water Quality (DWQ) that the activities proposed below may precede utilizing Nationwide Permit 39. We have addressed your included written comments in the following paragraphs. 1. Please show all stream impacts including all fill slopes, dissipaters, and bank stabilization on the site plan. Please refer to the attached Panther Rock Phase I Site Plan. Utilization of oversized culverts alleviates the use of dissipater pads and further stream impacts. The proposed stream impacts associated with Phase I are entirely within the hatched sewer and road crossing area. 2. Please show all wetland impacts including fill slopes on the site plan. The four jurisdictional wetlands within the proposed Panther Rock Phase I project are fairly small and located within NRB Zone 1. No wetland impacts are anticipated for Phase I. 3. Please indicate proposed lot layout as overlays on the site plan at a scale of no smaller than 1 "=50'. Also, show wetlands and streams on the same plan so we can determine if additional impacts are likely. Please refer to the attached Panther Rock Phase I Site Plan. Neuse R. Please refer to the attached Panther Rock Phase I Site Plan. The proposed Zone 1 and 2 buffer impacts associated with the road crossing are hatched accordingly. 5. Please provide diffuse flow provision measures, applicable worksheets and a signed and notarized Operations and Maintenance agreement for the site. Please refer to the attached level spreader worksheet and signed and notarized Operations and Maintenance agreement for the 56-foot concrete level spreader easterly adjacent to the proposed road crossing. Additionally, no rise curbs will be utilized along the entrance road to Panther Rock Phase I. These BMP's will promote diffuse flow into the stream paralleling the approximately 1,700-foot road. 6. Please indicate all stormwater outfalls on the site plan. stormwater associated with the entrance road (Street A) will utilize no rise curbs to promote sheet flow. The proposed detention pond and subsequent 56-foot concrete level spreader will provide stormwater control for the areas adjacent to Street A. Remaining areas, such as the sections adjacent to Street C, drain towards the east and away from the NRBRB areas. An incomplete submittal package will result in a request for additional information and will substantially delay final review and approval of the project. LEVEL SPREADER OPERATION AND MAINTENANCE AGREEMENT The level spreader is defined as an elongated, level threshold, designed to diffuse stormwater runoff. Maintenance activities shall be performed as follows: 1. After construction and until vegetation has been established, level spreader(s) shall be inspected after every rainfall. Thereafter, level spreader(s) shall be inspected at leasf every month and more frequently during the fall season and after heavy rainfall events: a. Accumulated sediment; leaves, and trash shall be removed, and repairs made if required. b. Inspect level spreader(s) for evidence of scour, undercutting, settlement of the structure, and concentrated flows downhill from the level spreader(s). c. A level elevation shall be maintained across the entire flow-spreading structure at all times. Repair or replace the level spreader if it is damaged. d. Mow vegetative cover to a height of six (6) inches and prune plants if they cover over half of the level spreader surface. e. Repair eroded areas and replace/replant dead or d<~maged vegetation. 2. The contractor should avoid the placement of any material on and prevent construction traffic across the structure. If the measure is damaged by construction traffic, it shall be repaired immediately. 3. Inspect and repair the collection system (e.g., catch basins, pipes, swales, riprap) four (4) times a year to maintain proper functioning.
