Old North State Water Company ("ONSWC") appreciates the opportunity to respond to the Notice of
Violation ("NOV") issued on September 14, 2020 by the Division of Environmental Quality regarding the
self -reported 550 on August 20, 2020, (NOV-2020-DV-0404).
As mentioned on a voicemail to you this morning by Lee Bowman, today was the first time that the
documented Managing Member of Old North State, John McDonald, was made aware of this NOV. You
may be aware that Old North State has terminated its relationship with Envirolink, Inc. for contract
operations the last week of September. We believe you will see improved communications, operations
and maintenance from Old North State moving forward. Also, please send all future correspondence for
Old North to John McDonald and remove Michael Myers from any official correspondence.
Please contact us if additional information is needed. While the violation was unfortunate, we would
ask for some consideration on not enforcing the civil penalty as we are working diligently to address the
contract operations issues and to diligently resolve many of the open issues that the previous operator
was not able to handle at Briar Chapel.
