D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
The applicant requested a detailed delineation of streams and wetlands of the proposed Apex Peakway corridor in order
to determine the extent and location of streams and wetlands within the area. The proposed roadway corridor has limited
permanent impacts to three road crossings, 2 of which are stream crossings and one crossing which is within a wetland
area. For the two proposed stream crossings, the applicant has opted to utilize bridges so as to avoid channel impacts.
Streams are not crossed multiple times by the proposed roadway. The proposed road crossings are necessary in order to
connect the existing termini of the Apex Peakway at South Salem Street (the northern boundary) and Tingen Road (the
southern boundary). The purpose of the proposed Apex Peakway is to build a four-lane divided roadway that will
service the proposed and existing residential developments in the area, as well as providing an alternate north-
south connector between NC 55 and US 1 in Apex. Road shoulders were made as steep as possible at the wetland
crossing locations (2:1) to minimize impacts.

Orange protective fencing will be placed outside of the impacted wetland/stream corridor to ensure protection of the non-
permitted wetlands/streams.

The NC-Natural Heritage Programs Virtual Workroom was used to search for elemental occurrences of state and
federally protected species in the vicinity of the project. It was determined based on the search that elemental
occurrences of one state species of concern exist within 2 miles of the center of the project area. There were no
elemental occurrences of federally threatened or endangered species within 2 miles of the center of the project area.

that dispute a determination made by the DWQ or Delegated Local may request a determination by the Director.
A request for a determination by the Director shall be referred to the Director in writing c% Cyndi Karoly, DWQ
Wedands1401 Unit, 2321 Crabtree Blvd., Raleigh, NC 27604-2260. You must act within 60 days of the date that
you receive this letter. Applicants are hereby notified that the 60-day statutory appeal time does not start until the
affected party (including downstream and adjacent landowners) is notified of this decision. DWQ recommends
that the applicant conduct this notification in order to be certain that third party appeals are made in a timely
manner. To ask for a hearing, send a written petition, which conforms to Chapter 150B of the North Carolina
General Statutes to the Office of Administrative Hearings, 6714 Mall Service Center, Raleigh, N.C. 27699-6714.
This determination is final and binding unless you ask for a hearing within 60 days.
The (owner/future owners) should notify the Division of Water Quality (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above). This project may require a Section 4041401 Permit for the proposed activity. Any inquiries should be
