Avoidance and Minimization 1 a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. The applicant requested a detailed delineation of streams and wetlands of the proposed Apex Peakway corridor in order to determine the extent and location of streams and wetlands within the area. The proposed roadway corridor has limited permanent impacts to three road crossings, 2 of which are stream crossings and one crossing which is within a wetland area. For the two proposed stream crossings, the applicant has opted to utilize bridges so as to avoid channel impacts. Streams are not crossed multiple times by the proposed roadway. The proposed road crossings are necessary in order to connect the existing termini of the Apex Peakway at South Salem Street (the northern boundary) and Tingen Road (the southern boundary). The purpose of the proposed Apex Peakway is to build a four-lane divided roadway that will service the proposed and existing residential developments in the area, as well as providing an alternate north- south connector between NC 55 and US 1 in Apex. Road shoulders were made as steep as possible at the wetland crossing locations (2:1) to minimize impacts. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. Orange protective fencing will be placed outside of the impacted wetland/stream corridor to ensure protection of the non- permitted wetlands/streams. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Does the project require Compensatory Mitigation for ? Yes ® No impacts to Waters of the U.S. or Waters of the State? 2b. If yes, mitigation is required by (check all that apply): ? DWQ ? Corps ? Mitigation bank 2c. Yes ® No within one of the NC Riparian Buffer Protection Rules? 1 b. If yes, then is a diffuse flow plan included? If no, explain why. Comments: This project is within the Cape Fear Basin and therefore, no diffuse flow ? Yes ? No plan is required. 2. Stormwater Management Plan 2a. What is the overall percent imperviousness of this project? N/A % 2b. Does this project require a Stormwater Management Plan? ? Yes ® No 2c. If this project DOES NOT require a Stormwater Management Plan, explain why: As the proposed project is a linear transportation project, it will be required to comply with the NCDOT Best Management Practices (BMP) Manual for stormwater runoff treatment, per Condition No. 12 of the General Certification No. 3820. Further, this project will also comply with the Town of Apex's Unified Development Ordinance. Stormwater from the site will be sent to devices within the adjacent development (Salem Village) and will be incorporated in the SMP approval for that development. If a copy of this plan is required by DWQ, then we request that a conditional approval be granted such that this plan is provided prior to impacts. 2d. If this project DOES require a Stormwater Management Plan, then provide a brief, narrative description of the plan: ? Certified Local Government 2e. Have you checked with the USFWS concerning Endangered Species Act ? Yes ® No impacts? E] Raleigh 5c. If yes, indicate the USFWS Field Office you have contacted. ? Asheville 5d. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? The NC-Natural Heritage Programs Virtual Workroom was used to search for elemental occurrences of state and federally protected species in the vicinity of the project. It was determined based on the search that elemental occurrences of one state species of concern exist within 2 miles of the center of the project area. There were no elemental occurrences of federally threatened or endangered species within 2 miles of the center of the project area. 6. Essential Fish Habitat (Corps Requirement) 6a. Will this project occur in or near an area designated as essential fish habitat? ? Yes ® No 6b. What data sources did you use to determine whether your site would impact Essential Fish Habitat? The proposed project is in Wake County which is not near any coastal or tidal habitat that would support EFH (i.e. salt marshes, oyster reefs, etc.) 7. Historic or Prehistoric Cultural Resources (Corps Requirement) 7a. Will this project occur in or near an area that the state, federal or tribal governments have designated as having historic or cultural preservation ? Yes ® No status (e.g., National Historic Trust designation or properties significant in North Carolina history and archaeology)? 7b. What data sources did you use to determine whether your site would impact historic or archeological resources? * Record checks at the State Historic Preservation Office or the Office of State Archeology were not performed. No structures older than 50 years were noticed within the corridor of the thoroughfare road during the wetland evaluation. The project is consistent with adjacent land uses. Further, the National Register of points produced by the NC SHPO (utilizing Google Earth) does not show any historic or archeological resources on the project site. 8. Flood Zone Designation (Corps Requirement) 8a. Will this project occur in a FEMA-designated 100-year floodplain? ? Yes ® No 8b. If yes, explain how project meets FEMA requirements: 8c.
