Sullins Director Dee Freeman Secretary October 5, 2010 Steve Smith, Interim Town Manager Town of Banner Elk 200 Park Ave Banner Elk, NC 28604 Subject: Request for More Information 401 Water Quality Certification Shawneehaw Stream Restoration Permit Modification and Revision DWQ Project # 09-0828 V2 Avery County Response deadline: November 8, 2010 Dear Mr. Smith: The Division of Water Quality (DWQ) has performed a preliminary review of a Pre-Construction Notification (PCN) Form submitted for the above referenced project. Additional information will be required in order to complete the review process. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Existing conditions - Existing conditions data, including, but not limited to, a longitudinal profile, multiple cross-sectional surveys, pebble counts, dimensionless ratio calculations, BEHI (Bank Erosion Height Index) analysis, and shear stress analysis for the proposed restoration segment. 2. Reference reach - Reference reach data on which the restoration design is based, including the elements listed above. 3. Structure details - Detailed plans, showing all structure types, installation techniques and minimum rock / log dimensions, along with in-situ stabilization techniques. Include discussions regarding minimum rock sizes, use of filter fabric, etc. 4. Structure Placement and Construction - The project proposes a significant amount of structures to be located within the restoration reach. Minimal design details have been provided as to how the structures will help achieve the stated goals of the project. Provide discussion on the following: Location: 2090 U.S. Highway 70, Swannanoa, North Carolina 28778 Phone: 828-29645001 FAX: 828-299-70431 Customer Service: 1-877-623-6748 Internet: www.ncwaterquality.org An Equal Opportunity 1 Affirmative Action Employer NorthCarolina Naturally Town of Banner Elk October 5, 2010 Page 2 of 3 • Considering the proposed log riffle placements are designed at other than perpendicular to the flow of Shawneehaw Creek, and as flows leave these type structures at a 90 degree angle to the last structure, how will this not result in an immediate bank destabilization downstream? • Considering that each log is to be anchored into the nearest bank (in most cases, in both banks) necessitating significant stream bank disturbance, how will long term bank stability be provided for? • How will aquatic life passage be ensured through these structures? 5. Success Criteria - Submit a monitoring plan, defining the success criteria, which complies with the Internal Technical Guidance for Stream Work in North Carolina, which can be downloaded at: http://portal.ncdenr.org/c/document library/get file?uuid=56bd6172-2331-43dc-99a4- a5895148bb27&groupId=38364 ). Please provide your response in writing to the addresses below prior to close of business on November 8, 2010.
