Box 1131 NOORESVlIiE REGl0SAL O CE49 Durham, NC 27702 Subject: Authorization to Construct Bessemer City Quarry NCG020054 Gaston County Dear Mr. Edgerton: In accordance with your application for an NPDES discharge permit originally received October 2, 1992 by the Division, we are herewith forwarding the subject Authorization to Construct for the construction and operation of the closed loop recycle system and for the construction and operation of a pit dewatering system with discharge of treated wastewater and stormwater into an unnamed tributary to Long Creek in the Catawba River Basin. This Authorization to Construct is issued pursuant to the requirements of North Carolina and the US Environmental Protection Agency Memorandum of Agreement dated December 6, 1983 and as subsequently amended. This permit supersedes WQ0007082, which should be deleted from your records. This Authorization to Construct is issued in accordance with Part III, Paragraph 2 of NPDES Permit No. NCG020000, and shall be subject to revocation unless the wastewater treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No. NCG020000. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement wastewater treatment or disposal facilities. The Mooresville Regional Office, telephone number (704) 663-1699, shall be notified at least forty-eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays. A copy of the approved plans and specifications shall be maintained on file by the Permittee for the life of the facility. Failure to abide by the requirements contained in this Authorization to Construct may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. Directions to Site: From the junction of Virginia Avenue (Highway 274 ) and 14th Street (Highway 274, also) in Bessemenr City, Gaston County, travel north on the latter approximately 0.8 mile to the junction with Bess Town Road (SR 1446). Proceed northwest on Highway 274 from the junction approximately 0.7 mile to the junction with a dirt road (W. S. Deck Drive) and the proposed quarry. The site is about 0.3 mile northwest of the junction. 6. Discharge Point(s). Topography (relationship to flood plain included): Hilly, sloping toward Long Creek at the rate of 3 to 13%. The site is not in a flood plain. 9. Location of nearest dwelling: Three dwellings are located within 900 feet of the proposed mining site. However, these houses will be removed in the future. 10. Describe receiving stream features and pertinent downstream uses: On the day of the site investigation there was no access road to the segment of Long Creek that was designated as the receiving stream. However, a segment of Long Creek above the proposed discharge point was inspected. The Creek appeared to have a very good flow but the water was turbid. Proposed wastewater will be discharged into Long Creek via onsite retention berms that are to be constructed for erosion control purposes. Downstream users are not known. Other Special Items: N/A PART IV - EVALUATION AND RECOMMENDATIONS Nello L. Teer Company has requested an NPDES discharge Permit for the discharge of wastewater generated from a mining operation. The proposed discharge consists primarily of stormwater plus groundwater collected in the mining pits. Pit water will be used as make-up water in a closed loop recycle system for a stone crushing operation. However, when stone crushing activity is decreased, excess pit water, if any, will be discharged into Long Creek via retention berms which are to be constructed to serve as erosion control features. It should be pointed out that the applicant has also applied for a Non -discharge Permit for the same mining operation. The Non - discharge Permit is for the construction and operation of a closed loop recirclulation system that is to be used for stone washing in the crushing process. The Mooresville Regional Office recommends that the proposed non-discahrge facility be permitted under the NPDES General Discharge Permit. ENGINEERING PROPOSAL FOR BESSEMER CITY QUARRY Effluent to be discharged into an unnamed tributary of Long Creek will consist primarily of onsite stormwater runoff pumped from the quarry pit during periodic dewatering and, to a lesser degree, of groundwater encountered during mining operations. Please see the erosion control plan for the location of the proposed discharge points. As proposed, the retention berms will serve as the main erosion control features onsite to retain stormwater runoff as it occurs and divert streamflow away from the pit area. This will facilitate the controlled release of runoff after the suspended load has settled out. The make-up water will come from pit dewatering, wells, and an unnamed tributary of Long Creek. It is anticipated that no treatment of the effluent will be necessary since a separate, closed recirculation system for plant process water is planned. In addition, the existing timbered land will be revegetated with pine seedlings and grasses, and stabilized prior to site development. This will further lessen the siltation of the ponds and the erosion control structures themselves. In conclusion, it is felt that there will be no adverse effects of the effluent discharge from the proposed Bessemer City Quarry site, neither in the initial stages nor in the later stages of quarry development.
