I am sending to you for review and comment a draft assessment document. As you will note, some
information is still needed, for example: the date the permit was renewed, the months in 1997 Mr. Fortner
submitted "no discharge" DMRs, and the date on which the mobile home park was connected to Gastonia's
system.
Also, we need to decide on the number of violations committed. Normally, as I recall, we would
allege 1 violation for failure to properly operate, occurring on the date of our inspection. Here, the operator
submitted DMRs indicating no discharge was occurring from the plant for several consecutive months. I
think we could argue that there was a violation on every day included in the DMRs.
Please review the document, note any necessary corrections or additions, and call me at your earliest
convenience to discuss this matter.

Acting pursuant to North Carolina General Statutes (N.C.G.S. )
§ 143-215 . 6A, I, A. Preston Howard, Jr. , Director of the Division
of Water Quality, make the following:
I . FINDINGS OF FACT
A. Mr. C. Wayne Fortner is the owner of a wastewater
treatment plant located at the Sante Mobile Home Park in
Gaston County, North Carolina. The plant at all times
relevant herein received wastewater generated by the
residents of the mobile home park.
B. NPDES Permit No. NC0075116 (hereinafter "the permit") ,
authorizing operation of the plant and the discharge of
wastewater to the waters of the State, was issued to Mr.
Fortner on 5 February 1993, to be effective from 5
February 1993 to and until 30 April 1994 . The permit was
renewed on and the renewal permit was
effective to and until 31 August 1997 .
C. The said permit, at all times relevant herein, contained
the following pertinent conditions :
1 . Part II .C. (1) of the said permit required the
permittee to employ a certified wastewater

treatment plant operator in responsible charge of
the wastewater treatment facilities.
2 . Part I .B of the said permit required the permittee
to properly operate and maintain the wastewater
treatment facility.
3 . Part III .E. required the permittee to add chlorine
disinfection to the treatment facility within 120
days of the original issuance of the permit.
D. A compliance monitoring inspection was conducted by duly-
authorized staff of the Division of Water Quality
("DWQ") , Water Quality Section, Mooresville Regional
Office, on 1 August 1997 . Information obtained during
that inspection revealed the following violations of the
permit:
1 . The permittee had not employed a certified
wastewater treatment plant operator in responsible
charge of the wastewater treatment facilities .
2 . The permittee was not properly operating and
maintaining the wastewater treatment facility. No
effluent was being discharged from the facility,
which at that time was serving 11 mobile homes .
Wastewater entering into the facility' s sandfilter
was apparently by-passing the outfall, since no
discharge was occurring at the permitted discharge
point.
3 . The permittee had not added chlorine disinfection
to the treatment facility.
Self-monitoring reports prepared by the permittee and
submitted to the DWQ for the months of January through
, 1997 stated that no discharge was
occurring from the facility.
E. NPDES Permit No. NC0075116 expired on 31 August 1997 .
F. The Sante Mobile Home Park was connected to the sewage
collection and disposal system of the City of Gastonia on
, 1997 .

G. Staff costs and expenses associated with detecting the
violations, defining their nature and extent, and
bringing the enforcement action total .
BASED UPON THE ABOVE FINDINGS OF FACT, I make the following:
II . CONCLUSIONS OF LAW
A. Mr. C. Wayne Fortner is a "person" within the meaning of
N.C.G.S . § 143-212 (4) .
B. NPDES Permit No. NC0075116 was at all times relevant
herein a permit required by N.C.G.S. § 143-215. 1 (a) .
C. The operational and maintenance provisions summarized in
Finding of Fact No. I .C. , above, are terms, conditions,
and requirements of the said permit.
D Mr. Fortner violated N.C.G.S. § 143-215 .1 (a) and NPDES
Permit No. NC0075116 on occasions when he failed
to employ a certified wastewater treatment plant operator
in responsible charge of the wastewater treatment
facility, as described in Finding of Fact No. I .D. ,
above.
E. Mr. Fortner violated N.C.G.S. § 143-215 . 1 (a) and NPDES
Permit No. NC0075116 on occasions when he failed
to maintain his wastewater treatment plant in good
working order and operate it as efficiently as possible
as described in Finding of Fact I .D. , above.
F. Mr. Fortner violated N.C.G.S. § 143-215. 1 (a) and NPDES
Permit No. NC0075116 on occasions when he failed
to add chlorine disinfection to the treatment facility
within 120 days of the original issuance of the permit,
as described in Finding of Fact No. I .D. , above.
G. N.C.G.S. § 143-215. 6A(a) provides that a civil penalty of
not more than ten thousand dollars ($10,000 . 00) per
violation may be assessed against a person who violates
or fails to act in accordance with the terms, conditions,
or requirements of a permit required by N.C.G.S. § 143-
215 . 1 .

H. N.C.G.S. § 143-215 .3 (a) (9) provides that the reasonable
costs of any investigation, inspection, or monitoring
survey may be assessed against a person who violates any
regulations, standards, or limitations adopted by the
EMC, or violates any terms or conditions of any permit
issued pursuant to N.C.G.S . § 143-215 .1, or special
order, or other document issued pursuant to N.C.G.S. §
143-215.2 .
G. Pursuant to N.C.G.S. § 143-215 . 6A(h) , the Director, DWQ
has the authority to assess civil penalties .
BASED UPON THE ABOVE FINDINGS OF FACT AND CONCLUSIONS OF LAW, I
make the following:
III . DECISION:
Pursuant to N.C.G. S. § 143-215 . 6A, in determining the amount
of the penalty, I have taken into account the Findings of Fact and
Conclusions of Law set forth above and considered the factors
listed in N.C.G.S. § 143B-282 . 1 .
Accordingly, Mr. C. Wayne Fortner shall be and hereby is
assessed a civil penalty of:

Permit No. NC0075116 occurring on
specifically,
failing to employ a certified
