A 5-day report was not submitted. Violations include failing to effectively manage, maintain, and operate the subject collection system so that there is no SSO to the land or surface waters and making an outlet to waters of the State for purposes of G:S. 143-215.1(a)(1), for which a permit Is required. December 3, 2020 Scott Vinson, Regional Supervisor Water Quality Regional Operations Section Raleigh Regional Office Divisions of Water Resources, NCDEQ Subject: Notice of Violation Tracking Number: N0V-2020-DV-0508 Sanitary Sewer Overflow - October 2020 Collection System Permit No. WQCS00192 Holly Springs Collections System Wake County Dear Scott Vinson, In reference to the above NOV, the following remedial actions have taken place to correct and prevent future occurrences of these overflows. The Water Resources after hours on -call attendant responded to a call about an overflowing manhole. We located the downstream manhole and used the high pressure jet trailer to remove what was causing the blockage. We removed what we found to be asphalt and other debris from the manhole invert and limed the area affected by the SSO. We also introduced fresh de -chlorinated water from a fire hydrant to dilute any gray water that may have entered the creek. We determined the cause of the SSO to be asphalt that was left in the manhole by a contractor who was overlaying the street in a newly constructed neighborhood adjacent to the spill area. The asphalt traveled from the new construction down to where they tied into a manhole in an existing outfall. The asphalt settled in this manhole invert, causing the existing outfall sewer line to become blocked, therefore causing the SSO. We are meeting with Development Services to establish more frequent manhole inspection protocols before and after paving events. The Water Resources Division is implementing more frequent manhole inspections in areas where new construction may be taking place. There was mention in the NOV about not having the five day report filled out in the required time. Deon Johnson, TOHS Collection ORC, logged into the BIMS site 10/14/2020 to complete the five day report. We completed all the information on the initial page and clicked save/submit. Normally after this, there are other pages available for us to fill out to explain the cause of the spill and remediation efforts. Those pages for some reason were not available. When we noticed the pages were not available, we contacted Mitchell Hayes and Buster Towel with DEQ to see what the issue may be. They looked on their system and could not find any issues. We also noticed there was never a five day report date populated in the BIMS Portal. We returned to the BIMS site for several days but could never locate the report. Each time we tried to select the edit button, it would say the report was already submitted, and we never received an opportunity to finish filing the five day report. We contacted Mitch Hayes again to ask about this and he stated everything looked good on his end. Please accept the cause of the spill and remediation explanations in this NOV response as what would have been submitted in the five day report. Also attached are documents showing dates when we last performed maintenance in that area and pictures of the debris that was found in the manhole.
