REQUEST FOR ADDITIONAL INFORMATION
Dear Mr. Bryant:
On August 23, 2010, the Division of Water Quality (DWQ) received your Preconstruction
Notification Form (PCN) dated August 20, 2010 regarding your request to replace and construct
water control structure's for the Point Peter Road Canal Water Control Structure. The DWQ has
determined that your application is incomplete and/or provided inaccurate information as
discussed below. The DWQ will require additional information in order to process your
application to impact protected wetland and streams on the subject property. Therefore,
unless we receive the additional information requested below, we will have to move
toward denial of your application as required by 15A NCAC 2H.0506 and 2B.0233(8)
and will place this project on hold as incomplete until we receive this additional
information. Please provide the following information so that we may continue to review
your project.
Additional Information Requested:
1. Proposed impacts from the hydraulic manipulation of wetlands and marsh areas are
ambiguous. The Pre Construction Notification (PCN) states that the hydrology of

41,590 acres of pocosin wetlands will be affected by the proposed water control
structure. The PCN states intent of the proposed structure is to restore a more
natural hydrologic condition. No example of a reference site is given to determine
projects success or failure, and if wetland restoration project will have a detrimental
effect on wetland flora, fauna, and biological integrity in violation of 15A NCAC
02B .0231 Wetland Standards. It is the conclusion of this Office that insufficient
information is provided to determine wetland impacts from proposed water control
structure.
It is requested that the hydrologic restoration plan be provided to this Office for
review showing the proposed hydrologic management plan, area of proposed
restoration, reference site; anticipated impacts and changes to vegetation, wildlife,
and aquatic communities within the proposed impact area. It is also necessary to
include information on how the proposed restoration will affect hydrology off-site
on adjoining properties.
Please respond in writing to the DWQ within 30 days of receipt of this letter with the
requested information. If we do not hear from you within 30 days, we will assume that
you no longer want to pursue this project and we will consider the project as withdrawn.
This letter only addresses the application review and does not authorize any impacts to
wetlands, waters or protected buffers. Please be aware that any impacts requested within
your application are not authorized (at this time) by the DWQ. Please call Roberto
