The Division of Water Quality received your letter dated September 9, 2010, in which
you discussed your clients' desire to culvert a stream at the Sunrise Plaza Shopping Center in
Murphy, North Carolina. I understand that you have subsequently been in direct contact with
Ms. Linda Wiggs of DWQ's Asheville Regional Office. Ms. Wiggs has also conferred with the
U.S. Army Corps of Engineers about your clients' site. Ms. Wiggs has provided you with
specific guidance as to how your clients should proceed with an application for a 401 Water
Quality Certification. Ms. Wiggs has advised that your clients' engineer should contact her in
advance of submittal of the permit application to facilitate the review process. The Division
concurs that the proposed impact is reasonable under the circumstances, and with the appropriate
stream mitigation and stormwater management as required under the conditions of a 401
Certification. !vls. Wiggs looks forward to working with your clients' engineer pursuant to
successful resolution of the problems discussed in your letter, while also protecting water
quality.

Dear Sirs:
This firm represents Lim's Brothers, LLC, the developer and owner of Sunrise
Plaza Shopping Center in Murphy, NC. That property fronts of U.S. Highway #64, and is
crossed by a small creek. In construction of the parking lot for the center, Lim's Brothers
had retaining walls constructed around the creek bed thus leaving the creek uncovered
and protected. This although all of the other lots along U.S. Highway #64 on which
businesses are located, covered the creek with driveways and parking ots,,insertng large
culverts into the creek bed, to conduct the flow.
In recent months, the retaining walls surrounding the creek have started to fail,
creating a large sunken area in the surrounding parking lot. The failure is progressive,
according to Lim's Brothers architect, and will eventually fail collapse. There is now a
pending lawsuit filed by Lim', Brothers against the contractor and subcontractor who
constructed the walls. To repair the damage, it. will be necessary to remove the existing
wall an' construct larger, more substantial ones, at an estimated cost of $450,000.00
Lim's Brothers has become aware of construction activity by Roy Wells and
Charles West on a lot a few hundred feet down U.S. Highway #64, which is crossed by
the same creek. That owner recently removed the existing structures and all of the
existing paved parking area. It is now in the process of inserting new culverts into the
creek bed, and has covered them with dirt, with plans to cover them with pavement.

The purpose of this letter is to inquire as to why Lim's Brothers should be singled
out and not allowed to insert a culvert into the creek and pave over it. If your agency
needs to inspect the area in question, please notify us so that we can arrange it. Time is
of the essence in this matter. I am not sure who has oversight in this matter, your agency
or the Army Corps of Engineers. Please notify me if I need to work through that agency.
