PROJECT SUMMARY: The applicant proposes to: • Install 188 linear feet of bulkhead, • Install 10 mooring pilings to create four 12-foot by 20-footboat slips, • Replace an existing 7-foot by 45-foot dock, • Remove two small existing piers, • Install a new 20-foot by 3-foot pier, • Install a 12-foot by 14-foot boatlift, and • Construct a three bedroom single-family residence with gravel parking area and new septic system. Project Setting The subject property is located on the southwest corner of the intersection of Harbor Road (SR 1224) and O'Neal Lane in Avon, Dare County. The .29-acre parcel wraps around the northeast corner of Avon Harbor, which is located on the western shore of Hatteras Island, immediately adjacent to the Pamlico Sound. Avon Harbor is "'~ "shaped and is connected to the Pamlico Sound by a 250-foot long and 150-foot wide channel that is situated in an east-west direction. The harbor's boat basin is approximately 400 feet long and 150 feet wide, with the longer axis situated in a north-south direction. The eastern shore of the basin contains two active and two inactive fish houses and their associated docks and boat slips. The northern, southern, and western shores of the basin contain boat slips utilized by small private and commercial fishing boats. Water depths in Avon Harbor are approximately 6 feet. The southern shore of Avon Harbor's entrance channel has been bulkheaded, but the northern shore has not been hardened. Most of the eastern shore of the harbor's basin has also been bulkheaded, but many sections of these structures have deteriorated and provide little or no shoreline protection. The vacant lot located to the west of the subject property has not had bulkhead or riprap installed. The subject property is bordered by O'Neal Lane to the north, Avon Harbor to the south, Harbor Road to the east, and an undeveloped lot to the west. The southeastern portion of the parcel contains one of the inactive fish houses. The western edge of the fish house, which is oriented in a north-south direction, extends 2 - 9 feet water ward of the normal water level (NWL) in Avon Harbor. This edge of the fish house is equipped with the remnants of a 7- foot wide dock that runs its entire 45-foot length. The remnants consist of the pilings once used to support the dock, some very minimal framing, but none of the decking. No ~ Field Investigafion Report Hooper - Avon, Dare County ~ Page 3 submerged aquatic vegetation (SAV) was observed under or near the dock area where water depths are 4 - 6 feet. The southern shoreline of the subject property contains 29 feet of deteriorating bulkhead. The shoreline immediately southeast of the bulkhead contains an insignificant Coastal Wetland fringe that is approximately 20 feet long and one foot wide. The Salt Meadow Grass (Spartina patens) fringe is located landward of NWL and is usually buried under thick mats of eel grass that are dislocated from the nearby Pamlico Sound and blown into the northeast corner of the harbor during regular southwest winds. The shoreline immediately west of the 29-foot section of bulkhead contains a larger more significant area of Coastal Wetlands containing Salt Meadow Grass (Spartina patens), Cordgrass (Spartina altinflora), and Black Needlerush (Juncus roemerianus). These areas of Coastal Wetlands extend up into an approximately 5-foot wide strip of U.S. Army Corps of Engineers Section 404 wetlands that wrap around the northeast corner of Avon Harbor. One small pier (18 feet long by 3 feet wide) extends from the small section of bulkhead. Another small freestanding remnant pier (14 feet long by 2 feet wide) is located just to the east. No submerged aquatic vegetation (SAV) was observed near the piers where the water depths range from one-foot deep at the bulkhead to five feet deep at the end of the pier. The northern portion of the parcel is vegetated with mowed weeds, indigenous grasses, and scattered Live Oaks (Quercus virginiana) and Wax Myrtle (Myrica cerifera). The subject property is located in a VE (Elevation 9) Zone. Elevations across the lot range from zero along the shores of the Avon Harbor to approximately four feet in the middle of the lot. Project Description The applicant proposes to install 188 linear feet of wooden bulkhead around the northeast corner of Avon Harbor. The bulkhead will be installed at NWL along the southern property boundary, but will extend 2-10 feet beyond NWL where the bulkhead will be installed immediately west of the existing fish house. Once the bulkhead is complete, the applicant proposes to re-install the framing and decking on existing pilings that once supported a 45-foot long by 7-foot wide dock that was located immediately west of the existing fish house. Ten mooring pilings will then be installed on the west side of the re-constructed dock to create four 12-foot by 20-foot boat slips that will be rented to small private and commercial fishing boats. The applicant also proposes to remove the two small existing piers and replace them with one 20-foot long by 3-foot wide pier. A 12-foot by 14-foot boatlift will be installed on the eastern side of the proposed pier. The residents of the proposed single-family residence will reportedly utilize both the pier and boatlift. Field Investigation Report Hooper - Avon, Dare County Page 4 Finally, the applicant proposes to construct a 24-foot by 40-foot piling supported single- family residence with 40-foot by 22-foot gravel parking area and new 700 SF septic system. 9. ANTICIPATED IMPACTS It is anticipated that the proposed project will cause the following impacts: • The construction of the proposed pier and re-construction of the previously existing dock will result in the shading of 376.5 SF of Estuarine Water /Public Trust Area AECs. • The construction of the proposed single-family residence will result in the disturbance of 1,359 SF of uplands located in the Estuarine Shoreline AEC and 1,137 SF of uplands located outside of the Estuarine Shoreline AEC. • The existing fish house and the proposed single-family residence will create 2,145 SF of impervious surface, or 18.6 % of the 11;518 SF of the parcel located within the Estuarine Shoreline AEC. • The construction of the proposed bulkhead will result in the filling of 0 392 SF of Estuarine Water /Public Trust Area AECs, 0 1,354 SF of Estuarine Shoreline AEC, 0 20 SF of an insignificant Coastal Wetland fringe located in the Estuarine Shoreline AEC, and 0 776.2 SF of U.S. Army Corps of Engineers Section 404 wetlands located in the Estuarine Shoreline AEC. • The construction of the proposed bulkhead will result in the placement of 7.26 CY of sand/soil below NWL. • The removal of the existing pier and the installation of the proposed pilings and pier will result in the temporary increase in turbidity of the waters in Avon Harbor. • A review of available maps indicates that no archaeological resources are located on or near the subject property. THIS "DISPUTED AREA" IS NEITHER INCLUDED IN THE TOTAL PROPERTY AREA CALCULATIONS FOR THE PROPOSED DEVELOPMENT NOR IN THE TOTAL IMPERVIOUS AREA CALCULATIONS. AGAIN, NO DEVELOPMENT ACTIVITIES ARE PROPOSED IN THE DISPUTED AREA. (The attached recorded deed differentiates the two parcels by listing the disputed area as not carrying a general warranty for land titling purposes). SO FOR THE REMAINDER OF THIS NARRATIVE THE AREA CLEARLY OWNED BY BASIL HOOPER WILL BE CALLED "SUBJECT PARCEL ". SUBJECT PARCEL The subject parcel (and site designated for proposed development) is comprised of 0.292 acres on the northeast corner of Avon Harbor (a federally maintained harbor) in Avon, NC. The existing features on the parcel clearly owned by Basil Hooper include a historic fish house with attached wood dock and decks (in various sates of repair), a septic tank that served the fish house, two (2) piers the northeast corner of the shoreline, portions of former bulkheading, (underneath the fish house and also on the north shoreline of the subject parcel), two existing piers and the remnants of one pier. Comprised of a former commercial fish house that was built in the mid to late 1940's, the applicant recently cleaned tip the inside and outside of the structurally sound building to prevent filrther dilapidation and to preser<~e the historical character of the building and site. The building structure (rough hewn cypress and cedar timber frame) and the associated 4 to 5 inch thick concrete slab foundation are structurally sound and the applicant desires to maintain the building's existing dimensions and location. Portions of a former bulkhead remain in the area along the south and southwest corner of the historic fish house. The proposed 188.5 LF bulkhead will be aligned just waterward of the tivestern margin of the fish house and will continue around the entire shoreline of the subject parcel with bulkhead backf ll impacts shown clearly on the attached plat and described below.. Portions of the waterfront dock that served the fish house were damaged (in approximately the year 2004) when a fatal airborne vehicular accident resulted in the northwest corner of the docking facility. The current pier and dock configuration in the northeast comer of the shoreline is a result of uncompleted replacement and repairs of the accident damaged structures authorized shortly after the accident by the Division of Coastal Management at a meeting with the applicant in the wake of this mishap. Replacement of the damaged pilings on the northwest corner of the dock attached to the fish house did occur but the deck boards were not replaced at this time duo to concentration of the applicants efforts on cleaning up of the inside of the fish house. The replacement of the deck boards are proposed in this application. The existing pier that traversed northward from the building and terminating in the northeast corner of the shoreline was partially destroyed in this mishap which resulted in the isolated pier which has no connection to land or the historic fish house. This remnant pier and an existing pier on the szcbject parcel are proposed for removal by this application. One proposed 20.5' X 3' wood pier and one boat lift (to serve the proposed residence) is proposed in place of the two existing piers to be removed (see below). The 404 Wetlands on site were flagged by Kendall Turnage and confirmed by the US Army Corps of Engineers on 2/6/2006 by the issuance of a US Army Corps Jurisdictional Determination. An insignificant fringe a Spatina patens exists in the northeast corner of the shoreline (and is so narrow as to be nearly unmappable on the plat and is noted within this narrative for recordation of its existence) and a significant area of coastal wetlands (Spartina alterniflora, Spartina patens and Borrichia frutescent) in the northwest shoreline of the subject property and continues into the shoreline of the disputed area. The proposed bulkhead will be constructed landward of the significant area of coastal wetlands. The applicant proposes the following activities: (oii sicbject parcel only) Site Preparation 1. Remove two existing wood piers and one existing mooring piling in northeast corner of shoreline on subject parcel (labeled as existing piers on "Current Conditions" plat. 2. Backfill activities: 1354 SF of Highground fill 776.2 SF 404 wetland fringe fill (portions are unvegetated and exist under the fish house) 392 SF of fill below NWL (mostly under fish house) (no SAVS have been observed by the agent or the Division of Coastal Management representative in this fill area) Repair, Reconfiguration and Maintenance of existing historic fish house and docking facility 1. Stabilize the concrete slab foundation and backfill the proposed bulkhead underneath the fish house.(activity addressed above and on Fornz MP-2) 2. Replace joist boards and place deck boards on the existing wood structure adjacent to the fish house. No proposed expansion of the dock is proposed. 3. Install 10 mooring pilings in order to create four boat slips on west side of the fish house to be rented or leased primarily for commercial fishing activities that the applicant . 4. Construct a new 20.5 X 3 ft pier on northern shoreline (which will actually serve the proposed home). 5. Install a boat lift and 4 boat lift support pilings on east side of the pier proposed directly above. Proposed Residence 1. Construct proposed 3 bedroom home on pilings with wooden slatted elevated unroofed wood deck (152 SF within 30 ft buffer). 2. Install 836 SF of gravel parking for residence parking 3.
